RECOMMENDATIONS
1. Take the following positions, as Governing Body of the Contra
Costa Water Agency on the legislation below:
AB 3426 (Eastin) - Water Planning
Support
SB 2530 (Marks) - Wetlands Protection
Support in concept
2 . Authorize Chair to sign letters to the above legislators
indicating the County's position on the above legislation in
detail.
3 . Direct the Fish and Wildlife Committee to report to the Water
Committee on relevant wetlands legislation by Assemblyman
Baker, Assemblyman Isenberg and Congressman Miller at their
next scheduled meeting.

BACKGROUNDJREASONS FOR RECOMMENDATIONS
1. At their meeting on June 28, 1990, the Board of Supervisors'
Water Committee considered each of the proposed legislative
bills and examined the rationale that justified the above-
stated positions for consistency with the County's established
water policy. A summary of the bills and rationale for the
County positions is on file with the Community Development
Department.

2. The Water Committee recommends further comnmication regarding AB 3426 and
SB 2530 in order to work with the authors regarding details of these bills.
AB 3426 - The Water Committee recommends that the County express support
regarding this bill, and offer assistance regarding
administration, the staff planning process and support, and the
composition of the task force.
SB 2530 - The Water Committee recam ends expressing County support-in-
concept, and registering concerns regarding agricultural/
industrial exemptions and the potential need for agricultural
operations to obtain permits for disking operations, as specified
in the amended version. The Water Committee also wishes to
comTunicate County concerns regarding wetland/habitat losses where
areas on the water side of levees are affected, and to encourage
legislation to control losses through the permit process.
3. Assemblemen Baker and Isenberg have sponsored a legislative package which
addresses wetlands issues as part of a North American Waterfowl Management
Plan (AJR 80, AB 4325 - AB 4328) . In addition, at the Federal level,
Congressman Miller has sponsored the Central Valley Fish and Wildlife
Restoration Act, which also addresses wetlands issues. The Water Committee
has requested a report in order to examine this legislation in detail, and
how these packages may interrelate.

POSITIONS OF THE CONTRA COSTA WATER AGENCY
ON SELECTED 1990 LEGISLATION
(FOR BOARD OF SUPERVISORS CONSIDERATION JULY 10, 1990)
AB 3426 - EASTIN - Water Planning
Summary
This bill would create a Water Planning task force to evaluate long-term
water problems, and provide methods by which consensus may be achieved
to resolve these problems. The task force would be required to prepare
a concise analysis of water problems and make recommendations to the
Governor and Legislature by November 1, 1993 . Funding would be through
the environmental license plate fund. The task force would be
terminated November 1, 1994 .

Rationale
Efforts to achieve consensus are essential to eventual resolution of
complex water issues evidenced by the slow process of establishment of
flow, salinity and other standards associated with the Bay-Delta
Hearings.
SB 2530 - MARKS - Wetlands Protection
Summary
This bill would prohibit wetlands alteration except through a permit
from the Department of Fish and Game (DFG) and a waste discharge permit
from a Regional Water Quality Control Board. The bill requires DFG to
adopt regulations for program implementation, including fee schedules,
and would include exemptions for certain agricultural and industrial
operations.
Recommended Position
Support in concept.
Rationale
This bill is consistent with County efforts towards wetlands
preservation and Bay-Delta water quality.
