Adopted this Order on July 1o, 1990 , by the following vote:

ABSTAIN: None.
SUBJECT: Authorization for payment of AFDC Mid-Month Warrants
in the Absence of a 1990-1991 State Budget
Upon the recommendation of the County Administrator and the
Social Service Director, the Board finds and orders as follows:
1 . Mid-month warrants amounting to approximately $2,100,000
for AFDC beneficiaries and daily supplemental AFDC warrants
approximating $270,000, are payable during the second half of July,
1990. The state budget for fiscal year 1990-1991 has not been enacted
as required by law, and Contra Costa County has been notified by the
State Department of Social Services that .if the state budget is not
enacted by July 12, 1990, the required state and federal funding for
the above-mentioned payments will not be advanced to the County. If
this occurs, unless Contra Costa County advances other funds under its
control, the mid-July aid payments to AFDC families will not be made
and the families will be without funds.
2 . The amounts necessary to make the mid-July 1990 AFDC
payments are within the estimated limits of the County's mandated AFDC
obligation for fiscal year 1990-1991 .
3 . The failure of the state to advance state and federal funds
for the mid-July AFDC payments and supplemental payments and the
failure of AFDC families. to receive those payments will. constitute an
emergency within the meaning of Government Code, section 29122.
4 . Pursuant to Government Code, sections 26227, 29122, and
29124, the Auditor-Controller is directed to authorize and the.
Treasurer to pay from available funds of Contra Costa County, the
warrants necessary to maintain the mid-July, 1990 .payments and July
1990 supplemental payments to qualified AFDC beneficiaries .
5 . The non-county share of all such payments shall be
recovered from the first 1990-91 AFDC allocation received by Contra
Costa County from the State of California.
6 . The County Administrator is directed to file a claim
against the State of California for the expenses of the advance of
county funds for the subject AFDC payments, including administrative
costs, legal costs, and interest.
7 . To the extent that the advanced county funds are not
recovered from 1990-91 state and federal AFDC allocations to Contra
Costa County, all such funds together with interest thereon, shall be
credited towards Contra Costa County's statutory share of AFDC payments
for the 1.990-91 fiscal year.
