BACKGROUND: On March 13 , 1990 the Board of Supervisors voted to support AB 2951 as it was introduced. On June 6, 1990 the bill was amended. Under current law there is no provision requiring a biennial survey of drug and alcohol use among pupils in grades 7, 9, and 11. AB 2951 would provide for such a biennial survey. Specifically, AB 2951 would require the following: 1. The survey must be designed to assess the following: * The frequency and type of substance abuse. * The age of first use and intoxication. * Pertinent attitudes and experiences of pupils. * The experience of pupils with school-based drug and alcohol prevention programs. * As an optional component, the survey may examine the risk factors associated with school dropouts. 3. The survey is to be based on a statewide sample of pupils enrolled in grades 7, 9, and 11 and is to be consistent with the surveys conducted by the Attorney General' s Office in the 1985-86, 1987-88 , and 1989-90 fiscal years. 4. The Attorney General is required to release the findings of the survey on or before May 1 of each even-numbered year. 5. The Attorney General is required to prepare a report on the survey and distribute it to the Legislature, the Governor, the Superintendent of Public Instruction, law enforcement agencies, school districts and interested members of the general public. 6. The survey is to be conducted in such a way that the confidentiality of participating school districts and individual pupils is maintained. The questionnaires and answer sheets are exempted from the public disclosure requirements of the Public Records Act. 7. Individuals reporting data pursuant to this bill are held free from liability for damages in any action based upon the use or misuse of pupil surveys that are mailed or otherwise transmitted to the Attorney General or his or her designee. 8. The implementation of the requirements of the bill are made subject to the availability of funding in the Budget Act for 1991-92 and each subsequent year, or upon funding made available for those purposes under federal law. It appears that passage and enactment of AB 2951 would further the Board of Supervisors war on drugs by providing a solid base of information on the extent of drug and alcohol use and on the extent of progress in reducing the use of drugs and alcohol on the part of school children. It is therefore recommended that the Board of Supervisors indicate its continued support for AB 2951. AB 2951 passed the Assembly Education Committee on March 27, 1990 by a vote of 10: 7. The bill passed the Assembly Ways and Means Committee on May 8, 1990 by a vote of 21: 0 and the full Assembly on June 11, 1990 by a vote of 71 : 0. The bill is currently on referral to the Senate Judiciary Committee where it was scheduled to be heard on July 3 , 1990. -3- cc: Assemblyman Steve Clute County Administrator District Attorney .
