SUBJECT: LEGISLATION: SB 2140 (Davis)
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMEENDATION
Adopt a position in SUPPORT of SB 2140 by Senator Davis which
would provide that additional persons, including active and
retired probation officers, are covered by provisions of law
making the address and telephone number of such officials
confidential.
BACKGROUND:
Existing law provides that, for purposes of the California Public
Records Act, the home address, telephone number, occupation, and
precinct number of active or retired judges, court commissioners,
district attorneys, public defenders, certain peace officers, and
the spouses and children of certain peace officers who live with
those peace officers which appear on any voter registration
affidavit is confidential, and shall not be disclosed to any
person, except as specified in the law if confidentiality is
requested at the time of voter registration or reregistration.
Senator Davis has introduced SB 2140 which does several things.
However, as amended May 15, 1990, the bill includes magistrates,
certain additional peace officers, active or retired deputy
district attorneys, and active or retired probation officers
within the scope of this law.
The County Probation Officer recommends that the Board of
Supervisors support SB 2140 because it provides an additional

officers. and other public officials in the justice area. It is,
therefore, recommended that the Board of Supervisors indicate
their support for SB 2140.
SB 2140 passed the Senate Judiciary Committee April 24, 1990 by a
vote of 7: 0. Hearing was waived by the Senate Appropriations
Committee and the bill passed the full Senate May 31, 1990 by a
vote of 30:2. The bill is currently on referral to the Assembly
Public Safety Committee where it was scheduled for a hearing on
July 3 , 1990.
