SUBJECT: ORDINANCE NO. 17 FOR SANITATION DISTRICT NO. 5. SET A HEARING DATE.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
The Board of Supervisors of Contra Costa County, as and constituting the Board of Directors
of Contra Costa County Sanitation District No. 5:
A. SET August 7, 1990 at 11:00 a.m. in the Board of Supervisor's Chambers,
651 Pine Street, Martinez, California, as the time and place for a public
hearing to consider oral and written objections or comments concerning
establishing the annual service charges for Sanitation District No. 5 Fiscal
Year 1990-91.

B. DIRECT THE CLERK OF THE BOARD to mail a notice of the time and place
of the hearing including a general explanation of the matter to be consid-
ered at least 14 days prior to the hearing to any interested parry who files
a written request with the District for mailed notice pursuant to Government
Code Section 54992.
C. DIRECT that, at least 10 days before the public hearing, the District shall
make available to the public data indicating the amount of cost, or
estimated cost, required to provide the service for which the charge is
levied, and the revenue sources anticipated to provide the service.
II. Financial Impact:
The above actions have no impact on County finances. County services to Sanitation District
No. 5 are funded entirely by the annual sewer service charges.
111. Reasons for Recommendations and Background:
Each year the County Sanitation Districts are required to set by Ordinance the annual sewer
service charges. Government Code Section 54992 describes what steps are necessary before
such an ordinance can be adopted.
IV. Consequences of Negative Action:
The District would be unable to collect sewer service fees for Fiscal Year 1990-91. The collection
and water treatment of sewage is necessary to protect the public health and the environment.
If the District is unable to collect the service fees it would have to borrow money to provide these
services, and future service charges will have to be increased to repay the borrowed money.
