RESOLUTION N0. 90/437 _
SUBJECT: Settlement of Condemnation of Graunstadt Property for
Subdivison 6935 in the Oakley area. (Contra Costa County
vs. Pauline L. Graunstadt, Superior Ct. C/N C89-00566) .
On January 17, 1989, this Board approved an Agreement with Oakley
Associates for the acquisition of offsite right of way owned by
Pauline L. Graunstadt which fronts on Laurel Road and Highway 4 in
the Oakley area.
The Public Works Director has reported that the condemnation
of said right of way for the offsite widening of Laurel Road and
Highway 4, was concluded in the Superior Court of California on May
17, 1990.
NOW THEREFORE BE IT RESOLVED that the Agreement with Oakley
Associates, as approved by the Board on January 17, 1989, is TERMINAT-
ED, the corporate security bond issued by Developers Insurance Company
is EXONERATED and the Public Works Director is AUTHORIZED to refund
the $3, 000 cash deposit less expenses incurred by the County (W.O.
3024- Auditor's Deposit No. 150376, dated December 30, 1988) plus
interest in accordance with Government Code Section 53079, if appro-
priate, to Oak Builders, Incorporated.
