INVESTIGATION OF LAND USE PERMIT #2138-86 FOR THE BYRON
GAS & MINI MART
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Accept report on investigation of land use permit #2138-86
for the Byron Gas & Mini Mart.
2. Request that within six months Environmental Health conduct
a field test of well water conditions located near the Byron
Gas & Mini Mart and report findings to the County
Administrator.
BACKGROUND:
On February 27 , 1990 , the Board of Supervisors by motion of
Supervisor Tom Torlakson directed the Community Development
Department, Environmental Health Division of the Health Services
Department, and the _County Administrator ' s Office to investigate
allegations that conditions of approval for Land Use Permit
#2138-36 have not been met with regard to the installation of a
collect and convey system.
Residents of the area around the Byron Gas & Mini Mart located at
the southeast corner of the Byron Highway and Camino Diablo have
been concerned that their yards and wells are being contaminated
by gasoline, oil and anti-freeze by a ditch carrying rainwater
from the gas station through the area.
No problems have been found by each county department
investigating the area.

The following specifics of the investigation were found to be:
1. The drainage ditch in question draws from a large area
and is subject to potential contamination from a
variety of sources including paved roads and the
railroad.
2. No requirement exists for a collect and convey system
subject to Board action on May 5, 1987.
3 . As a alternative to the collect and convey system, the
market operator has installed a sump to skim off
petroleum-based compounds prior to surface waters being
discharged to the ditch.
4. The market owner employs the operation of a blower to
clean the market' s paved areas so that any runoff of
surface waters is limited to rainwater.
5. To confirm no water table contamination, testing was
conducted of a shallow domestic water well located
approximately 50 feet from the ditch. The ensuing
laboratory report indicated no organic contaminants.
6. Several residents in the area have a potential solid
waste violations which could serve as non-point sources
of pollution to the ditch. These require abatement
before the next rainy season and have been referred to
the code compliance operation for attention.
Based on the aforementioned information it appears that at this
time no reasons exist to indicate a need for further action other
than a follow-up report as a precaution. This report should be
delivered to the County Administrator for his review and action
as necessary.
All appropriate staff will routinely, during performance of their
regularly schedule field trips in this area, make visual
inspections of the ditch and take all necessary action should
contamination appear.
