W. and Sons, Inc. $684,300 $729,300 Payment 3855 Cypress Drive, Suite A $364,650 Petaluma, CA 94954 Faithful Performance $729,300 Page Construction Co. , Novato, CA Echo West, Inc. , San Francisco, CA `The Base Bid Item 1 represents the total bid less the $45,000 supplemental work allowance reserved for future change orders. The above-captioned project and the specifications therefor being approved, Addenda Nos. A and B, being issued and bids being duly invited and received by the Director, Justice Systems Programs; and The Contract Compliance Specialist having determined that the lowest responsible bidder has satisfied the County's MBE/WBE "good faith effort"; and The Director, Justice System Programs, recommending that the bid listed first above is the lowest responsible bid and this board concurring and so finding; IT IS BY THE BOARD ORDERED that the contract for the furnishing of labor and materials for said work is awarded to said first listed bidder at the listed amount and at the prices submitted in sufficient bonds as indicated above; and that the County Administrator's Office shall prepare the contract therefor; and 'v Award of Contract for Martinez Detention Facility, F and M Module Remodel Page Two IT IS FURTHER ORDERED that after the contractor has signed the contract and returned it, together with bonds as noted above and any required certificates of insurance or other required documents, and the Director, Justice System Programs has reviewed and found them to be sufficient, the Director, Justice System Programs is authorized to sign the contract for this Board; and Y. IT IS FURTHER ORDERED that in accordance with the project specifications and/or upon signature of the contract by the Director, Justice System Programs, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for bid security shall be returned; and IT IS FURTHER ORDERED that the Director, Justice System Programs is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to Section 4590 of the Government Code. FINANCIAL IMPACT There are no financial impacts, except that the recommendation will reduce paper work and make the administration of building construction contracts more timely and efficient. REASONS FOR RECOMMENDATION/BACKGROUND A. The Public Contract Code, Section 20142, specifies that, "The Board of Supervisors may, by board order, authorize the County Engineer, or other county officer, to order changes or additions in the work being performed under construction contracts". Section 20142 requires that such orders shall be in writing and that the extra costs for any change or addition to the work so ordered shall not exceed ten percent of the amount of original contracts exceeding $50,000, but in no event shall the extra cost of any change or addition to the work so ordered exceed $25,000. B. The construction contract contains a $45,000 Supplemental Work Allowance for change orders. No single changes exceeding $25,000 nor cumulative changes exceeding the Supplemental Work Allowance will be authorized without the Board of Supervisors' approval. C. Authorization is needed so that the County can continue to process building construction contract change orders in a timely ma r.
