Adopt resolution authorizing the Superior Court' s participation in the pilot project of electronic recording as the official court record, authorized by Section 270, Code of Civil Procedure. FINANCIAL IMPACT: Funding for this Productivity Investment Fund project is available from repayments made to the revolving fund this year. The Superior Court will repay the funds within a two-year period.. BACKGROUND: The Productivity Investment Fund Program, designed to encourage departments to explore ways to improve productivity and efficiency in handling their operations, is a revolving fund. This allows departments the opportunity to apply for funding as money is available. The Superior Court' s request is for $75,000 to purchase a video recording system in one Family Law Department. The system will produce and serve the needs of the Court as the official court record. Payback will be generated through salary savings. In addition, copies of the video recording will be available to attorneys for a nominal fee which will generate revenue. Z -2- In 1986, the Legislature passed Assembly Bill 825, adding Section 270 to the Code of Civil Procedure and authorizing eleven demonstration projects of audio and video recording in the Superior Courts of specified counties in lieu of the record prepared by court reporters. Statutes 189, Chapter 678 , amended CCP 270 to expand the demonstration project to 75 superior court departments selected by the Judicial Council. Contra Costa has been authorized by the Judicial Council to use electronic recording in three judicial departments as part of this demonstration project. A condition of participation is the adoption of a resolution by the Board of Supervisors finding that there are sufficient funds for the project. The Productivity Board and the County Administrator approve funding. The acquisition of the equipment will allow the Superior Court to participate in , the statewide demonstration project piloting electronic recording as the official court record. The County will benefit in the long term because the costs associated with the official court record will be reduced substantially. This Productivity Investment Fund project is viewed by the County Administrator as exempt from the freeze because of the long-term savings associated with the purchase of the equipment. ' THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA Adopted this order on June 5, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson, Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 90/ 356 SUBJECT: Participation in .demonstration project of electronic recording as the official court record, authorized by section 270, Code of Civil Procedure. The Contra Costa County Board of Supervisors RESOLVES that the Recommended Action herein is taken: I . Recommended Action Adopt resolution finding there are sufficient funds available through the County' s Productivity Investment Fund to enable the Superior Court to participate in the demonstration project authorized by the Code of Civil Procedure, section 270, using electronic recording for the official court record. II. Financial Impact The long-term impact of the electronic recording demonstration project ids cost reduction. The County'.s initial investment to purchase video recording systems through the Productivity Investment Fund will be repaid within two years. The recording system is used in lieu of a court reporter for the official record. Consequently, the salary savings from a court reporter position held vacant is used to repay the investment in full and then remains a long-term cost reduction. III. Consequences of Negative Action Without adoption of this resolution, the Court loses the opportunity to use electronic recording for the official court record in three judicial departments.
