Subject: Condition of Approval 36.4 of the Marsh Canyon Sanitary Landfill
Project Land Use Permit
Dear Chair Fanden and Board Members:
On March 16, 1990, the Solid Waste Commission discussed Condition of Approval
36.4 of the Marsh Canyon Sanitary Landfill Project Land Use Permit, which estab-
lishes a $200,000 annual fee to be used for a resource recovery program. The
Commission is very concerned about the assessment. of this $200,000 fee as well
as the procedure for imposing new fees. We understand that the proposed
resource recovery program would affect incorporated areas as well as unincorp-
orated areas. Thus, we believe that this program should be reviewed by the
cities and the Solid Waste Commission. As you know, new fees such as the
$200,000 affect ratepayers countywide. We believe that the cities and the
franchising agencies should be afforded the opportunity to comment on new fees
before they are imposed.
The Commission requests that the Finance Committee and the Board defer their
decision on the recycling projects which would be funded by this $200,000 until
we have an opportunity to review the proposal . We further request that the
Board refer the $200,000 fee, Exhibits A, B and C of the Marsh Canyon Sanitary
Landfill Land Use Permit and all other proposed landfill tipping fees to the
Solid Waste Commission for review.
The Solid Waste Commission is also concerned that we are not receiving informa-
tion on projects or solid waste issues which we believe to be in the Commis-
sion' s purview. Please direct staff to submit solid waste issues to the Solid
Waste Commission for review and recommendation.
