On June 5, 1990 the Employee Relations Officer's designee submitted a Side Letter dated May 21 , 1990 (Attachment A), entered into with the Public Defenders ' Bargaining Unit of Local No. 1 outlining a revised Public Defender Wage Formula for purposes of recalculating a percentage wage adjustment effective July 1 , 1989. 2. This Board having thoroughly considered said Side Letter agreement, same is approved. 3. If an Ordinance(s) is required to implement any of the foregoing provi- sions, the Board of Supervisors shall enact said Ordinance(s) . President c/o Public Defender's Office Dear Mr. Mariano: This is to confirm our agreement to redo the Public Defender Wage Formula for purposes of recalculating a percentage wage adjustment effective July 1, 1989 for represented Deputy Public Defender classifications. Following two meet and confer meetings with you and Mr. Dan Cook,' it was agreed that for the following agencies the following June 30, 1989 top step rates would be used in calculating the M.O.U. formula detailed below: AGENCY TOP STEP 1. STATE OF CALIFORNIA 6524 $54,082 9 =. $6009 Avg. x Enhancement: $6009 x 1.025 = $6159 Target Salary = $6159 on June 30, 1989 Deputy P.D.IV = $5850 on June 30, 1989 Formula = 4% + 2%: $5850 x 6% = $6201 Rate Effective July 1, 1989 = $6201 Pursuant to this agreement, the Auditor--Controller will compute a lump sum retro for employees in the job classifications of Deputy Public Defender I, II, III, and IV,- utilizing the "Base". definition previously agreed to in Section 5.2B of the current Local No. 1 Memorandum of Understanding. ..-eF..•e _.F!r �_-3i." t.r,A. _ -..Fed_. _'7 .l7 ::'(�.y.,.�.T�..,v5..- Lump sum payments, computed by multiplying the "Retro Pay Base" (RPB) for the period from July 1, 1989 through April 30, 1990 by 2%, will be added to employees June 10, 1990 paychecks. These payments will be identified separately on paycheck stubs as "Lump Sinn Payment", and will be subject to normal tax withholding and retirement deduction requirements. If an employee believes there is an underpayment resulting from this methodology exceeding $30.00, the employee should contact the Personnel Department. Personnel and the Auditor-Controller will investigate and generate the additional pay, if owed, as soon as possible.
