SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECONS ENDATION
Indicate that the Board of Supervisors continues to SUPPORT AB
3010 by Assemblywoman Speier which would establish the Office of
Perinatal Substance Abuse in the Department of Alcohol and Drug
Programs and require the Office to form an interagency task force
on perinatal substance abuse and authorize the Office to
distribute funds to counties to fund residential and
nonresidential alcohol and drug treatment programs for pregnant
women, postpartum women and their children.
BACKGROUND:
On March 20 , 1990 the Board of Supervisors voted to support AB
3010 by Assemblywoman Jackie Speier. On May 8, 1990 the bill was
amended.
AB 3010, as amended May 8, 1990, would do all of the following:
1. Make findings regarding the serious problem of substance
abuse among pregnant women and the resulting damage which is
done to their newborn babies.
2. Establish the Office of Perinatal Substance Abuse in the
Department of Drug and Alcohol Programs (hereafter "the
Office" ) .

3 . Require the Office to create an interagency task force
composed of representatives of the Department of Alcohol and
Drug Programs, Department of Health Services, Department of
Developmental Services and Department of Social Services.
Representatives of the Department of Housing and Community
Development, State Department of Education and the State
Department of - Mental Health could also be members of the
task force. The Department of Alcohol and Drug Programs
would be designated as the lead agency for . the development
of a coordinated state strategy for addressing the treatment
needs of pregnant women, postpartum women and their children
for alcohol and drug abuse.
4. The Office would be authorized to distribute funds, as they
are made available through the budget process, to counties
to fund residential and nonresidential alcohol and drug
treatment programs for pregnant women, postpartum women and
their children and to fund other support services directed
at bringing pregnant and postpartum women into treatment and
caring for alcohol and drug exposed infants. Any funding
which is provided must be used to either initiate new and
innovative alcohol or other drug dependency treatment
programs or other support services tailored to meet the
needs of pregnant women, postpartum women, and their
children or to strengthen and expand. current treatment
programs or other support services deemed by the department
to be effective in treating pregnant women, postpartum
women, and their children for alcohol or drug dependency.
5. In selecting counties to receive funds the Office could
include in its guidelines consideration of the ability of
the county to provide or arrange for identified special
needs of : pregnant women and postpartum women who are
chemically dependent and are seeking alcohol or drug
treatment services.
6. Programs could be funded for treatment of alcohol abuse
only, drug abuse only or both alcohol and drug abuse.
7. Counties would be permitted to contract with non-profit
organizations to provide these services.
8 . Any -county which chooses to apply for funds from the Office
would be required to establish a perinatal substance abuse
coordinating council which would be required to select an
agency or department of the county to be the lead agency to
coordinate the alcohol and drug abuse program and to provide
for other coordinating efforts which are identified in the
bill.
The needs of pregnant and postpartum women and their children for
alcohol and drug abuse treatment services are identified in the
County' s Drug & Alcohol Action Plan as among the more pressing
needs in the County. Since AB 3010 has the potential to assist
the County in meeting some of these needs the bill appears to
further the Board of Supervisors ' war on drug and alcohol abuse.
It is therefore recommended that the Board of Supervisors
continue to indicate its support of AB 3010.
AB 3010 passed the Assembly Health Committee on April 24, 1990 by
a vote of 20 : 0 and- is currently awaiting a hearing before the
Assembly Ways and Means Committee.
