SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Indicate that the Board of Supervisors continues to be in SUPPORT
of SB 2025 by Senator Boatwright which would allow an employee of
a 1937 Act County who is laid off due to a reduction in force a
period of one year within which to obtain employment with another
public agency which has reciprocal retirement benefits with a
1937 Act County' s retirement system providing the reemployment
occurs on or after January 1 , 1989 .
BACKGROUND:
on March 6, 1990 the Board of Supervisors voted to support SB
2025 by Senator Boatwright. The bill was amended on March 21 ,
1990 . On April 17 , 1990 the Board of Supervisors voted to
support these amendments. On May 14 , 1990 the bill was again
amended.
Under current law an employee who leaves employment with a 1937
Act County, such as Contra Costa County, has 90 days within which
to enter employment with another public agency which has
reciprocal retirement benefits with the employee' s prior
retirement system, thereby allowing the employee to leave his or
her retirement contributions on deposit and to defer his or her
retirement until he or she retires from the subsequent employer.
During the lay-offs which occurred in the County in 1989, at
least one employee was laid off and it required more than 90 days

before the employee was able to obtain employment with another
public employer which has reciprocal retirement benefits with the
Contra Costa County retirement system. As a result, the employee
was unable to leave his retirement contributions on deposit and
take advantage of the deferred retirement privileges to which he
would have been entitled if he had obtained such employment
within 90 days.
The employee asked the Contra Costa County Retirement Board to
sponsor legislation which would extend the period of time within
which to obtain employment with another public employer so that
he could leave his contributions on deposit with Contra Costa
County and take advantage of the deferred retirement and other
privileges to which an employee is entitled when he or she
obtains employment with another public agency which has such a
reciprocal arrangement with Contra Costa County.
The Retirement Board agreed to sponsor SB 2025 by Senator
Boatwright. As amended May 14, 1990, SB 2025 would allow an
employee one year, rather than 90 days, within which to obtain
employment with another public agency which has reciprocal
retirement benefits with a 1937 Act County' s retirement system.
However, this provisions is only available to an employee who was
laid off because of a reduction in force and only when the
reemployment occurred on or after January 1, 1989. As amended
.May 14 , 1990 , the bill provides that it is only applicable to a
county when the board of supervisors, by resolution, makes the
provision applicable in that county.
The May 14, 1990 amendments applied the bill to 1937 Act counties
only when the board of supervisors votes to make the provision
applicable in a particular county.
Since the bill is optional with each 1937 Act county and since
the bill is being sponsored by the Retirement Board it appears to
be appropriate for the Board of Supervisors to indicate its
continuing support for SB 2025.
SB 2025 passed the Senate by a vote of 38: 0 on May 17, 1990 and
is awaiting a Committee assignment in the Assembly.
