HomeMy WebLinkAboutMINUTES - 06051990 - 1.63 TO: BOARD OF SUPERVISORS ..r Contra t, FROM: Costa; Phil Batchelor, County Administrator os Count DATE: May 30, 1990 ~` SUBJECT: LEGISLATION: SB 1894 (Ayala) SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOME2NDATION Indicate that the Board of Supervisors continues to SUPPORT SB 1894 by Senator Ayala which would increase the maximum penalty for possession of specified combinations of chemicals at the same time with the intent to manufacture PCP or methamphetamine. BACKGROUND: On February 27 , 1990 the Board of Supervisors voted to support SB 1894. On May 2, 1990 the bill was amended. Under current law, it is a felony, punishable by imprisonment in the state prison for 3 , 4, or 5 years for any person to possess specified combinations of chemicals at the same time with the intent to manufacture PCP, methamphetamine, or N-ethylamphetamine or specified analogs of those substances. Senator Ayala has introduced SB 1894 which would, as amended May 2, 1990, change these penalties to 2 , 4, or 6 years in the state prison. Since SB 1894 increases the maximum penalty for violating the laws relating to the manufacture of illegal drugs it appears to be consistent with the Board of Supervisors ' war on drugs. It is, therefore, recommended that the Board continue to indicate its support of SB 1894.
