RECOMMENDATION
Indicate that the Board of Supervisors continues to SUPPORT SB
1886 by Senator Craven which would revise the limits on the cost
of construction changes which the Board of Supervisors can
delegate to a County official to approve.
BACKGROUND:
On April 10, 1990 the Board of Supervisors voted to support SB
1886 . On May 8 , 1990 the bill was amended.
Under current law, the Board of Supervisors can authorize the
County Engineer or other County officer to order changes in work
being performed under construction contracts. The maximum value
of changes which the Board of Supervisors can delegate is not to
exceed $5000 when the total amount of the original contract does
not exceed $50, 000, or 10% of the amount of the original contract
if the original contract exceeds $50 ,000 but in no case can the
change which is authorized exceed $25,000.
SB 1886 leaves in place the authority for changes to contracts,
the value of which does not exceed $250,000. It adds authority
to approve changes on contracts which exceed $250,000 by
authorizing the County Engineer or other County officer to
approve changes on contracts whose original amount exceeds
$250,000, as long as the change does not exceed $25,000 plus one

percent of the amount by which the contract exceeds $250,000 , but
in no case can the change exceed $100, 000. For example, on a
contract worth $1,000,000 a County officer could be authorized to
approve a change order for as much as $32,500 ( $25,000 plus one
percent of $750,000) . This would mean that the County Engineer
or other officer could approve changes worth $100 ,000 on a
contract whose original value was $7,750, 000 or more ($25,000
plus one percent of $7 ,500 , 000) .
The Director of General Services recommends that the Board of
Supervisors support SB 1886 since the value of change orders
which can be delegated to a County officer has not been increased
to keep up with inflation. The authority to delegate such change
orders is optional with the Board of Supervisors and would remain
optional under SB 1886.
The May 8, 1990 amendment allows the board of supervisors to
provide this authorization by ordinance, resolution, or board
order, rather than simply by board order.
SB 1886 passed the Senate Local Government Committee May 7, 1990
by a vote of 8: 0. The bill passed the Senate Floor May 10, 1990
by a vote of 35:0 and is currently on referral to the Assembly
Local Government Committee.
