RECOVA4ENDATION
Indicate that the Board of Supervisors continues to be the
SPONSOR of SB 1878 by Senator Boatwright which would include the
County' s temporary court commissioners in computing the number of
judicial positions the County has for purposes of calculating the
County' s Trial Court Block Grant.
BACKGROUND:
On February 13 , 1990 the Board of Supervisors indicated that it
was the sponsor of SB 1878 by Senator Boatwright. On May 14,
1990 SB 1878 was amended.
Under current law, each County which has opted into the Trial
Court Block Grant Program receives a block grant each year based
on the number of judicial positions the County has. The
calculation of the number of judicial positions does not take
into account .temporary court commissioners. Contra Costa County
is the only County which has statutory authority to implement a
program of using temporary court commissioners to replace
commissioners who are ill, on vacation, filling in for one of the
judges or where there is a vacancy. The County currently uses
nearly the equivalent of one fulltime commissioner in terms of
the number of hours worked by the temporary commissioners. All
of the funds to pay these temporary court commissioners currently
is County General Fund money.

SB 1878 has been introduced by Senator Boatwright at the request
of the Board of Supervisors to include the proportion of time
served by temporary court commissioners in the calculation of the
number of judicial positions the County has for purposes of
determining the County' s Trial Court Block Grant. The May 14,
1990 amendments clarify the formula used to calculate the
proportion of. a temporary court commissioner position for which
the county is entitled to be reimbursed by indicating that the
county will be reimbursed for the actual hours worked by
temporary court commissioners, not to exceed 1/3 of a full-time
position. Since the actual Trial Court Block Grant substantially
exceeds the actual costs of a temporary court commissioner
position and since the County is already reimbursed for its
overhead and support costs through inclusion of the current
judicial positions and court commissioners in determining the
amount of the County' s Trial Court Block Grant, these amendments
will allow the county to be reimbursed for the actual costs
involved in paying a temporary court commissioner, up to 1/3 of a
commissioner position, which should reimburse the county in full
for its actual out-of-pocket expenses.
Since SB 1878 has been introduced at the request of the Board of
Supervisors and since - the amendments have been formulated with
the agreement of the Municipal Court Administrator and the County
Administrator' s Office, it would be appropriate for the Board to
indicate that it continues to be the sponsor of SB 1878 .
SB 1878 has passed the Senate Judiciary Committee and passed the
Senate Appropriations Committee on May 21, 1990.
