HomeMy WebLinkAboutMINUTES - 06051990 - 1.59 1-059 y� TO: BOARD OF SUPERVISORS Contra .^ A FROM: f•... / Costa oialKa < Phil Batchelor, County Administrator =; m County DATE: May 29, 1990 SUBJECT: LEGISLATION: SB 1830 (Cecil Green) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION Indicate that the Board of Supervisors continues to SUPPORT SB 1830 by Senator Cecil Green which would permit a city or county to adopt more stringent requirements than are reflected in the Uniform Building Code and Uniform Fire Code relating to fire and panic safety as are found to be reasonably necessary because of local climatic, geological or topographical conditions. BACKGROUND: On April 24, 1990 the Board of Supervisors voted to support SB 1830 on the recommendation of the Chief, Consolidated Fire District. On May 22, 1990 the Board of Supervisors reaffirmed this support for the bill as it was amended April 24 , 1990. On May 15, 1990 the bill was amended again. The State Fire Marshal is charged under current law with adopting fire and life safety standards for residential occupancies, including single family dwellings. This is done through the State Building Standards Commission. These adopted standards are considered to be minimum fire and life safety requirements. Many, if not most, communities within the State make amendments to these standards to address needs or concerns within their own city, county or fire district. These may be in the form of fire-safe roofing materials, built-in fire extinguishing systems, fire alarm systems and similar fire protection features. SUPERVISORS AND COUNTY ADMINISTRATOR BY DEPUTY M382 (10/88) The Attorney General has issued an opinion indicating that local governments. do not have the right to modify the State Building Standards on these matters. SB 1830 has been introduced by Senator Cecil Green. As amended May 15, 1990, SB 1830 would clarify that cities and counties do indeed have , the authority to adopt more stringent standards relating to fire and panic safety which are found to be necessary because of local climatic, geologic or topographical conditions. This finding requires that the city or county have adopted the Uniform Building Code or the Uniform Fire Code or both. In this case the city or county could, by ordinance, adopt more stringent requirements. The bill provides that any fire district which adopts the Uniform Building Code or the Uniform Fire Code or both such codes shall submit requests to amend these codes relating to fire and panic safety to any city or county wherein the amendments would apply. The governing board of the city or county would be required to approve or deny the request of the fire district . by majority vote. The bill also provides that any fire district- which submits any code amendments to the governing board of a city or county shall provide the city or county with all documentation supporting the proposed modifications, including, but not limited to, any relevant research and statistics and must provide staff work necessary to provide any information requested by the city or county. The bill excludes from a city, county or fire district' s authority to modify such standards, fire and panic safety requirements for the public schools which have been adopted by the State Fire Marshal. The bill also requires that an ordinance adopted pursuant to these provisions be made available for public inspection at the building department of any city or county where the ordinance would apply. In addition, the ordinance would have to be filed with the State Building Standards Commission for informational purposes. The State Building Standards Commission would have no authority to approve or disapprove the ordinance. SB 1830 has passed the Senate Housing and Urban Affairs Committee and is currently pending a hearing in the Senate Appropriations Committee. In view of the support provided for SB 1830 by the Chief, Consolidated Fire District and the nature of the amendments which have been made it is recommended that the Board of Supervisors reaffirm its support for SB 1830 as amended May 15, 1990. cc: Senator Cecil Green County Administrator Chief, Consolidated Fire District County Counsel Director of Building Inspection Les Spahnn, SRJ.
