Direct the Community Development Director to commence a rezoning of Assessor's Parcel Numbers 377-071-029, 031, 032, 033, 035, 037, 038, 039, 040, and 041 from A-2 General Agricultural to a zoning which is consistent with the General Plans and Zoning Regulations of the City of Martinez and the County of Contra Costa. BACKGROUND INFORMATION: This request is made by the Community Development Department in behalf of Mr. and Mrs. Daniel J. Spillane of 1075 Marie Avenue, Martinez, California 94553 who appeared before the Board on February 4, 1990 and expressed their concerns of agricultural uses, which are not compatible with the adjacent residential areas, being made of agricultural properties to the rear of approximately ten residences on the south side of Marie Avenue immediately west of Morello Road. On 27 April 1990 a meeting, as ordered by the Board of Supervisors, was held with Mrs. Daniel J. Spillane, John Gregory, and the Zoning Administrator, Karl Wandry to discuss zoning issues as they relate to the Spillane property at 1975 Marie Avenue, Martinez, CA 94553. The Spillanes property is one of ten properties which are located within both the incorporated City of Martinez and the unincorporated County of Contra Costa. Each of the properties are split by the City Limit line. The City of Martinez portion of the properties, fronting on Marie Avenue, are zoned R-6 Residential Single Family (6000 square feet) and the County portions, at the rear of the , residences abutting a railroad right-of-way, are zoned A-2 General Agricultural . Mrs. Spi11anes concern is the possibility of uses not compatible with residential uses, being made of the A-2 General Agricultural . Specifically, the concern is that livestock may be kept on the small portions of agricultural property, creating vector and odor nuisances. It was determined by the Zoning Administrator that the A-2 General Agricultural District portions of the property had the correct General Plan designations to institute a zone change of them.
