Pursuant to the authority in Government Code Sections 26820.6 and 26820.8 (as interpreted by the Legislative Counsel) , Section 68090, Section 72055.2 and Section 72056.5, this Board hereby amends Resolution No. 88/769 and fixes the following component and total Court filing fees in this County for the calendar years 1990 and 1991 under the following Government Code Sections: Government Code Secs. 26820.4 and 26827 (Super. FINANCIAL IMPACT: The recommended action is permitted by Chapter 56, Statutes of 1990 and would amend various State Code Sections to permit the Law Library filing fees to be increased by up to $8. The legislation also permits the total filing fees to be increased. Thus, no other agency which is supported by other components of the filing fees will be negatively impacted and every component which contributes to those agencies will be maintained at the current level. It is estimated that an increase in the Law Library filing fees will contribute up to $200,000 for the Law Library. REASONS FOR RECOMMENDATION/BACKGROUND: This recommendation is made by the Law Library Trustees. Civil filing fees are the main source of revenue for the County Law Library and have been for the last one hundred years. These fees account for about all of the Library operating revenue. The Law Library depleted its reserve upon relocating to the A.F. Bray Courts Building in 1988. As a result of the depletion, collection cancellations were made to balance the 1988/89 and 1989/90 budgets to income revenue. This was accomplished by cancelling subscriptions, looseleafs, treatises and supplements. No new publications or titles have been added since, further diminishing collection integrity, nor has much needed staff been added. According to the Council of California County Law Librarians, during the last ten years personnel costs have doubled and the cost of legal publications, books, periodicals and court reports have more than doubled. The rapid growth of this County's population has placed an even greater demand for boo d services on the Law Library's resources and staff. Law Library Filing Fees Page 2 June 20, 1990 This fee increase will be used to: (1) reinstate the library collection from the point of cancellations in 1988 and continue to expand upon that collection to keep pace with ever-growing patron demand, which in turn, requires additional staff. (2) The new and much larger Law Library location needs revenue for office equipment, such basic items as cabinets, typewriters, adding machines, etc. . The furniture now used in the Law Library for patron seating and staff work stations is borrowed from the County surplus. (3) Extended hours are needed to better serve Law Library patrons and the legal community. (4) West Law and/or Lexis computerized legal research systems are needed to assist patrons with their research. The capability for these systems is in place and ready for the hardware. (5) The two copying machines now in use receive such heavy use, not only by the public, but by the Courts and other County Agencies, they must be upgraded this next year. (6) Also needed is a telefax machine. Inter-library loans could be accomplished within minutes instead of days, with less staff involvement and no postage charges. (7) Contribute the library's proper share to the library remodel now planned for Bay Court in Richmond. The eight dollar increase is needed not only to accomplish the above, but to keep pace with continued growth and inflation. It is also necessary to re-establish a reserve in the Law Library Trust Fund for future security, thus preventing a reoccurrence of the current fiscal crisis.
