HomeMy WebLinkAboutMINUTES - 06261990 - 1.78 1-078 Vmt,a Costa Coily TO: BOARD OF SUPERVISORS FROM: Phil Batchelor, County Administrator DATE: June 13, 1990 SUBJECT: West County Justice Center, Project Management Consultant (O'Brien-Kreitzberg & Associates) Specific Request(s) or Recommendation(s) & Background & Justification RECONNEMATION ACTION APPROVE Amendment No. 5 to the Consulting Services Agreement with O'Brien-Kreitzberg & Associates, Inc. to extend and expand their managing services, and AUTHORIZE the County Administrator or his designee to execute the Amendment. FINANCIAL IMPACT Amendment No. 5 establishes a payment limit of $1,881,649 for the Bidding and Construction Phase, West County Justice Center, Project B (WH101F) and $110,335 for,,the M - and F - Module Remodel at the Martinez Detention Facility (WH2O5F). These payment limits represent increases of $302,154 and $44,895 respectively. Funds for these additional services are budgeted as part of the county's match to the State's Proposition 2, 16, and 52 grants. REASONS FOR RECOMMENDATION/BACKGROUND As a result of overcrowding at the County's adult facilities in Martinez, Clayton (Marsh Creek) and Richmond (Work Furlough), the County made application for a $36,570,521 grant to the California Board of Corrections in 1983. This grant was approved for the development of the 560-bed West County 'Justice Center in accordance with the County Jail Capital Expenditure Bond Act (Pro osition 2 and 16). Amendment No. 5 Approval Page Two Reasons for Recommendation (continued) The Consulting Services Agreement with O'Brien-Kreitzberg & Associates (OKA) calls for project and construction management services through the end of construction based on a contract completion date of April 9, 1990. Due to actual and anticipated construction delays caused by weather, code interpretations, design errors and omissions and unforseen conditions and an anticipated longer move-in and start-up period, the OKA Management Services will now be required until October 1990. The Contract identifies longer administration and inspection of construction as an acceptable basis for extra services. In addition to the WCJC, OKA is also providing project and construction management services for remodeling M - and F- Modules. At the time OKA's Services were originally negotiated for this project, the scope of work was limited to one module and a construction budget of $425,000. During design, the scope of work was expanded within M-Module and new work was added in F-Module. The construction budget has increased to $875,000. The period of construction has increased from four months to six months. Funds for this expanded scope of construction are available from the State Proposition 52 grant. Funds for the increased construction management services is part of the mandated 25% County match. In order to construct these new and altered County detention facilities given these changes to project scope and schedule, O'Brien-Kreitzberg & Associates' services require the extension to their contract limit. Based on the terms of the contract, the County only pays for the level of effort actually provided. CONSEQUENCES OF NEGATIVE ACTION If this contract amendment is not approved, the project management consultant will be forced to reduce it's staff and delete essential services. The elimination of such services, such as full time inspection and change order negotiations, will increase the County's exposure to unacceptable levels of risk, both cost and quality construction.
