HomeMy WebLinkAboutMINUTES - 06261990 - 1.7 Recorded at the request of: Contra Costa County A Return to: Public Works Department Records Section THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 26, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 90/423 SUBJECT: Completion of Improvements, and Declaring Certain Roads as County Roads, Subdivision MS 5-85, Antioch Area. The Public Works Director has notified this Board that the improvements in Subdivision MS 5-85 have been completed as provided in the Subdivision Agreement with Bridgehead Center Partnership heretofore approved by this Board in conjunction with the filing of the Subdivision Map. The Public Works Director having also notified this Board that Bridgehead Center Partnership, subdivider, has requested an eighty- five percent performance bond reduction for the duration of the warranty period and has submitted substitute security in the form of a letter of credit dated June 8, 1990, issued by Concord Commercial Bank with Bridgehead Partnership as principal, in the amount of $9, 695 for faithful performance. The Public Works Director having also notified this Board that the subdivider has submitted a letter of credit dated June 8, 1990, issued by Concord Commercial Bank with Bridgehead Center Partner- ship as principal, in the amount of $35, 650 for labor and materi- als, as substitute security for the letter of credit dated February 26, 1987, issued by Concord Commercial Bank (Letter of Credit No. 010002-3) with Bridgehead Center Partnership as principal. NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of June 26, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT SURETY March 31, 1987 Concord Commercial Bank Letter of Credit BE IT FURTHER RESOLVED that the widening of State Highway 4 and Bridgehead Road are ACCEPTED, as shown and dedicated for public use on the Parcel map of Subdivision MS 5-85 filed April 8, 1987, in Book 127 of Parcel Maps at page 10, Official Records of Contra Costa County, State of California. BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby established, and the $1,000 cash deposit (Auditor's Deposit Permit No. 121354, dated March 13, 1987) made by Bridgehead Center Partnership be RETAINED for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code. BE IT FURTHER RESOLVED that the aforesaid letters of credit dated June 8, 1990 are ACCEPTED as substitute security. BE IT FURTHER RESOLVED that the aforesaid substitute letter of credit dated June 8, 1990 for the payment of labor and materials be RETAINED for the six-month lien guarantee period until December 26, 1990, at which time the Public Works Director is AUTHORIZED to exonerate the letter of credit if no claims are on file, or to draw on the letter of credit in the amount of any claims on file. RESOLUTION NO.90/423 Completion of Improvements for Subdivision MS 5-85 June 26, 1990 ' Page Two BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED to exonerate the letter of credit dated February 26, 1987, issued by Concord Commercial Bank (Letter of .Credit No. 010002-3) with Bridgehead Center Partnership as principal, in the amount of $70, 300 for faithful performance and $35, 650 for labor and materials.
