Spooner, Contracts AdministratCIO Costa DATE: June 14, 1990 County SUBJECT: Approval of Contract Amendment Agreement #26-177-4 7 with CuraCare SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Health Services Director or his designee (Frank Puglisi, Jr. ) to execute on behalf of the County, Contract Amendment Agreement #26-177-4 with CuraCare, effective September 1, 1989, to amend Contract #26-177-2 (effective from September 1, 1989 through August 31, 1990) , as amended by Contract Amendment Agreement #26-177-3, to increase the Contract Payment Limit by $27, 000 from $45, 000 to a new total Contract Payment Limit of $72, 000. II. FINANCIAL IMPACT: Funding for this service is included in the FY 1989-90 Enterprise I Budget and in the FY 1990-91 Enterprise I Budget projections. As appropriate, patients and/or third-party payors will be billed for services. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: On October 31, 1989, the Board approved Contract #26-177-2 , effective September 1, 1989 through August 31, 1990, and on February 6, 1990, approved Contract Amendment Agreement #26-177-3 , with CuraCare to provide ultrasound services for Merrithew Memorial Hospital. The payment provisions of the Contract have been based on the Contractor's Fee Schedule for certain procedures. Because of the complexity and rapid development of this technology, new diagnostic procedures are continually becoming available, and the Contractor has been using these new procedures, as they become available, in the provision of professional ultrasound diagnostic services for the patients which are referred by the County. There has been no provision in the Contract to pay the Contractor for new diagnostic studies which are not listed in the fee schedule even though Department staff approved such studies. CC: Health Services (Contracts) ATTESTED JUN 2 6 1990 Risk Management Phil Batchelor,Clerk of the Board of Auditor-Controller Suvorvisors and County Administrator Contractor M382/7-83 BY DEPUTY CuraCare Contract Amendment #26-177-4 Page 2 The Contractor has been invoicing the County for all the diagnostic studies it has been providing to the County since the Contract became effective, and there are unpaid bills back to September 1, 1989 for services the Contractor performed in good faith, as requested by the County, but which cannot be paid under the terms of the current Contract. This problem only recently became apparent following the resignation of the program manager, and the Department is eager to clear its account with Curacure. Approval of Contract Amendment Agreement #26-177-4 will provide enough additional funds to pay for the ultrasound services the Contractor has already rendered to the County and to allow continua- tion of the services to the end of the contract term. In addition, the amendment agreement modifies the Payment Provisions so that the Contractor may use new diagnostic procedures as the technology develops.
