SUBJECT: LEGISLATION: AB 3879 (Woodruff)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of AB 3879 by Assemblyman Woodruff
which would increase the sentence enhancements for persons
convicted of specified controlled substance offenses within 1000
feet of a school and would make such enhancements apply to
convictions which occur within 1000 feet of specified state or
local parks, rather than just schools.
BACKGROUND-
Existing law provides a sentence enhancement of 3 , 4 , or 5 years
for any person 18 years of age or older who is convicted of
specified controlled substance offenses when he or she is on the
grounds of a public or private school or within 1000 feet of a
school.
Assemblyman Woodruff has introduced AB 3879 which, as amended May
17 , 1990, would expand this provision to include persons
convicted of specified controlled substance offenses while on the
grounds of or within 1000 feet of a state or local public park.
In addition, AB 3879 provides that any person who is convicted of
a misdemeanor which takes place on the grounds of or within 1000
feet of a state or local public facility shall receive an
additional punishment equal to the amount of the punishment for
the offense and any person who is convicted of a felony which
takes place on the grounds of or within 1000 feet of a state or
local public park shall receive an additional punishment of 1, 2,
or 3 years.

AB 3879 appears to be consistent with the Board of Supervisors
Alcohol and Drug Action Plan in that it increases the punishment
for drug offenses which occur within 1000 feet of a school or
other state or local public park. It is therefore recommended
that the Board of Supervisors indicate its support for AB 3879.
AB 3879 is pending a hearing before the Assembly Public Safety
Committee.
