BACKGROUND- Existing law provides a sentence enhancement of 3 , 4 , or 5 years for any person 18 years of age or older who is convicted of specified controlled substance offenses when he or she is on the grounds of a public or private school or within 1000 feet of a school. Assemblyman Woodruff has introduced AB 3879 which, as amended May 17 , 1990, would expand this provision to include persons convicted of specified controlled substance offenses while on the grounds of or within 1000 feet of a state or local public park. In addition, AB 3879 provides that any person who is convicted of a misdemeanor which takes place on the grounds of or within 1000 feet of a state or local public facility shall receive an additional punishment equal to the amount of the punishment for the offense and any person who is convicted of a felony which takes place on the grounds of or within 1000 feet of a state or local public park shall receive an additional punishment of 1, 2, or 3 years. PHIL BA HELOR,CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR M382 (10/88) BY DEPUTY AB 3879 appears to be consistent with the Board of Supervisors Alcohol and Drug Action Plan in that it increases the punishment for drug offenses which occur within 1000 feet of a school or other state or local public park. It is therefore recommended that the Board of Supervisors indicate its support for AB 3879.
