SUBJECT: Hearing On Appeal By. Save Mt. Diablo On Minor Subdivision ' MS 100-88 In The Clayton/Marsh Creek Area. This' is the .time time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal by Save Mt. Diablo from the decision of the Contra Costa County Planning Commission acting as . the Board of Appeals on the application by Willard ,1G. and Naomi L. Morgan (applicants and owners) requesting approval ,fof a tentative map for Minor Subdivision #100-88 to divide 160 acres into four ( 4) parcels in a General Agricultural District (A-2 ) in the Clayton/Marsh. Creek area. Karl Wandry, Community Development Department,: presented the staff report and background on the appeal before the Board today, describing the proposed site, the Zoning Administrator' s approval for four lots with restriction of development rights on all but two acres of the parcels, the Board of Appeals decision approving the project without the restriction of development rights, and "the appeal before the Board today. He advised of the staff recommendation that the Board uphold the Planning Commission decision. i Supervisor Torlakson requested clarification from staff on the restricted development envelope. Mr. Wandry responded to Supervisor Torlakson' s request. The public hearing was opened and the following persons appeared to speak: Willard G. Morgan, 6040 Morgan Territory Road,, Clayton, applicant, requested denial of the appeal of Save Mt. Diablo, and spoke on issues- including opposition to the dedication of development rights. Chris Valle-Riestra, 257 Vernon Street #.321 , Oakland, representing Save Mt. Diablo, spoke in opposition to the project, and requested denial of the project, but commented that if the Board were inclined to approve the project, that an Environmental. Impact Report should. be required first. He also spoke on concerns including the Planning Commission action of removing the dedication of development . rights, removal of the language existing in condition three requiring that there be producing water wells on each site before recording of the map and that there be septic tank locations identified. He commented on issues including the cookie cutter approach to rural subdivisions, very little compliance with the ranchette policy and that an Environmental Impact Report should be prepared to consider the cumulative impacts of this and other nearby subdivisions and re-subdivisions. Cheryl Morgan, 6040 Morgan Territory Road, Clayton, requested approval of the pro.ject., Mr. Morgan spoke in rebuttal.' Supervisor Torlakson advised that he was not prepared to make a recommendation today, and that he would like time to meet with the applicant and Save Mt. Diablo to address concerns raised today on various issues. : Supervisor Torlakson moved to continue the hearing on this matter for four weeks.
