Babst THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution, on June 12, 1990, by the following vote: AYES: Supervisors Powers, Schroder, McPeak,' Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 90/_L69 Resolution of Termination of Offer of Dedication (S. & H. Code § 8335) SUBJECT: Termination of Offer of Dedication of a portion. of Chelsea Drive, No. V2073D, W. O. 1821, Martinez Area. The Board of Supervisors of Contra Costa County RESOLVES THAT: This Termination of an Offer of Dedication of a certain excess right of way not required for public road purposes, is,made pursuant to Government Code Section 664772(c) and to Division 9, Part 3,- Chapter 4 of the Streets and Highways Code, commencing with Section 8330. This termination request is for an Offer of Dedication of a portion of Chelsea Drive located in the Martinez area. A description of the offered area to be terminated is attached hereto as Exhibit "A" and iincorporated herein by reference. This termination request is for an excess right-of-way of a street not required for street purposes(S. & H. Code Section 8334). This activity is not subject to California Environmental Quality Act pursuant to Section 15061 (b) (3) of Chapter 3 of the CEQA Guidelines as it can be seen with certainty that there Is no possibility that the activity may have a significant effect on the environment. Considering all facts before it,this Board FINDS there is no reasonable probability that the County will accept the offered roadway that no public money has been expended for maintenance of the offered roadway, and that it is in the best interests of the County and the public that the offered area be privately owned and maintained. June 12, 19W Page 2 This Board hereby TERMINATES the hereinabove described offer of dedication and ABANDONS the right of the County to accept said offer. The Board is not aware of any existing in place utilities in the subject area. The Real Property Division Is ORDERED to record a certified copy of this Resolution in the office of the County Recorder. From and after the date thico s resolution Is recorded, the offer of dedication is terminated and the County's right to accept offer Is abandoned. APN 367-170-014-Farr EXHIBIT "A" Parcel One: A portion of that 60 feet in width strip of land offered to Contra Costa County by Alhambra Valley II, a joint venture, and recorded January 20, 1975 in Volume 7413 of Official Records at pages 460 and 461. Said strip is shown on the map of Subdivision MS 123-73 (filed January 7, 1975 in Book .36 of Parcel Maps at page 32) as lying within PARCEL B (36 PM 32). The portion being vacated lies southeasterly of the parcel designated"POWELL (6141 OR 747)" on said map (36 PM 32) and lies entirely within that parcel of land granted to Aldo Rocca et ux recorded November 28, 1977 in Volume 8605 of Official Records at page, 978. Parcel Two: All of that 60 feet in width strip of;land offered to Contra Costa County by L. Thorton Powell et al and recorded January 20, 1975, in Volume 7413 of Official Records at page 463. Said strip is shown on the map of Subdivision MS 123-73 (filed January 7, 1975, in Book 36 of Parcel Maps at page 32) as lying adjacent to said Subdivision and within the parcel designated "POWELL (6141 OR 747)" ori said map (36 PM 32). Said strip lies within that parcel of land granted to James Farr et ux.recorded May 31, 1979, in Volume 9376 of Official Records at page 641. RESERVING THEREFROM PARCEL ONE AND PARCEL TWO: Pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain, operate, replace, remove, and renew those existing and in place utilities, as of the date of recording this instrument, in, upon, over and across any, highway or part thereof proposed to be abandoned, including access to protect the property from, all hazards in, upon, and over the area herein before described to be abandoned..
