SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Refer to the Environmental Affairs Committee, County Counsel, Health Services Department, Community Development Department and the County Administrator's Office to fully investigate whether the composting operation on Holland Tract by Bay Area Paper Recycling, contracted by Gaylord Container Company, is a waste disposal operation or an acceptable soil amendment operation. Staff investigation should focus on whether there is any threat to water quality or any other health or environmental threat. The investigation should focus on whether any activity has taken place to validate that this operation is an agricultural soil amendment operation. Is the material being worked into the base soil? Are crops being grown? Is the amended soil being sold for agricultural purposes? BACKGROUND INFORMATION: Darrell Edwards of the Bethel Island area has contacted code enforcement staff on many occasions over the last year regarding his concern about the composting . operation on Holland Tract. Please refer to the attached information. for details . Supervisor Fanden requested staff to notify the above noted speakers of the time this matter will be heard by the Environmental Affairs Committee on May 14, 1990. Supervisor McPeak requested Dr. William Walker to report on what is acceptable for soil amendments and also for compost use. She referred to a study conducted by the University of California at Davis. The Board then approved the recommendations as amended by Supervisor Torlakson to include coordination of the investigation with the Resional Water Quality Control Board; also the referenced Committee and County Departments were requested to investigate the report of ash disposal on Jersey Island by the Fish and Wildlife Study Committee. Comments regarding the report and questions which should be addressed as part of the Report of Waste Discharge are enclosed. Since your discharge of waste could affect the quality of waters of the State, you are required to submit to the Regional Board, a report of the discharge. When we receive you report, complete with the additional information, we will review the report, and either formulate waste discharge requirements or a waiver of requirements. Enclosed are a blank Report of Waste Discharge form and additional information requirements. The completed report and additional information should be submitted to this office by 5 April 1990. A new filing fee schedule is being prepared, but is not complete. Therefore, if any filing fee or annual fee applies to your report, you will be billed. Where and when was it sampled? Page 9 Figure 2 (Soil Types) . Provide descriptions of soil types. Page 10 Figure 3 (Drainage/Pumping Schematic). Provide a legend. Page 11 Table 3 Check the units the data is reported in. Heavy metals levels appear to be pg/l concentrations rather than mg/l concentrations as indicated. Page 14. Table 4 (Crop Management Practice) . Provide crop yield data. Page 15 Figure 4 (Crop Patterns) Provide legend and explain crop patterns. Page 15 Figure 4 Field numbers have N or S prefixes, presumably indicating north and south. Many soil test results have sample ID numbers with A or B prefixes or no prefix. Provide a clarification of where the soil samples were taken. Page 16 Under Soil Enrichment, explain "other wastewater treatment generated solids. " Mention is made of "fertilizer materials delivered, " but nowhere in the report is there any discussion of types and amounts of fertilizer materials used. Provide analysis, rates of application and timing of fertilizer applications, and field numbers where materials were applied. Laboratory test results on paper waste material show a wide variety of nitrogen levels. Does the material vary that much in nitrogen levels? What is the actual range and average nitrogen in the waste stream? What level is used to determine rates of application to cropland? Laboratory test results on soil samples show some areas of very high nitrogen levels. How do you account for the high levels of soil nitrogen? What is the area/extent of the high nitrogen levels? Provide maps showing the following: 1 . Fields which have received waste material in past years. 2. Fields which are presently receiving waste material . 3. Fields to, which you plan to apply waste material . Provide the crops being Mwn or planned on each field for 1990. What crops will be grown in theJuture scuss crop rotation if known) . Bay Area Paper Recycling, contracted by Gaylord Container , submitted a permit application for composting on Holland Tract . They have since withdrawn the application because of county restrictions . Bay Area Paper Recycling can , however , continue to deposit paper pulp as a soil amendment without a permit . The pulp must be spread and worked into the soil . The county has conducted a zone investigation . The operation was found to be handled correctly. The county will continue to conduct zone investigations periodically. If Bay Area Paper Recycling is found to be in violation , a cease order will be issued . The county will file charges if that becomes necessary.
