SUBJECT: Hearing On Appeal By Vincent and Penny Granberg on
Land Use Permit #2030-89, Bellecci and Associates And
Nick Salluce, in the Oakley area.
On April 24, 1990, the Board of Supervisors continued to this
date the hearing on the appeal by Vincent and Penny Granberg
(appellants) from the decision of the East County Regional Planning
Commission as the Board of Appeals upholding the Zoning
Administrator' s decision on the request by Bellecci and Associates
(applicant) and Nick Salluce (owner) to approve the establishment of a
commercial dog kennel ( #2030-89) in the Oakley area.
Mary Fleming, Community Development Department, presented the
staff report on this matter, describing the proposed site and
commenting on the Zoning Administrator' s approval and the appeal. Ms.
Fleming advised of the Planning Commission recommendation and she also
commented on the staff recommendation to accept the Environmental
Impact Report as adequate, deny the appeal, and uphold the decision of
the East County Regional Planning Commission. Ms. Fleming also
responded to questions from Board members including the proximity,
number and types of proposed cages and other kennel locations in the
County.
The public hearing was opened and the following persons appeared
to speak:
Frank Bellecci, Bellecci and Associates, 2252 Stanwell Drive,
Concord, representing the owner, Nick Salluce, spoke in support of the
proposed land use permit.
Nicola Salluce, P.O. Box 986 , Oakley spoke in favor of the
proposed land use permit.
Vince Granberg, 4180 Sellers Avenue, .Oakley, spoke in opposition
to the kennel and presented material and pictures to the Board.
Evo Baldocchi, 6390 Sellers Avenue, Oakley, spoke in opposition.
Helen Baldocchi, 6390 sellers Avenue, Oakley, presented a card in
opposition.
Elmer and Jean Johnson, 6040 Sellers Avenue, Oakley, submitted a
card in opposition.
John S. Huffman, Rt. 2, Box 182 AA, Oakley, spoke in opposition.
Louhwinder Sidher, 6357 Sellers Avenue, Oakley, submitted a card
in opposition.
Mr. Bellecci spoke in rebuttal.
Randy Bither, Mr. Salluce ' s prospective daughter-in-law and
prospective operator of the proposed kennel, advised she had petitions
( not submitted to the Clerk of the Board) , spoke in favor of the
project and responded to the Supervisors ' questions on the project.

The public hearing was closed.
Supervisor Torlakson questioned staff on the land uses permitted
in A-3 zoning.
Victor Westman, County Counsel, responded to Supervisor
Torlakson' s question.
Supervisor Torlakson commented on the good reputation of the
Salluce family, on this being a good idea in the wrong place, on the
proximity to homes in the area, ground water and wells, and the noise
involved in a kennel operation. He moved to deny the application and
over rule the Zoning Administrator' s approval based on the
incompatible land use concerns.
IT IS BY THE BOARD ORDERED that the appeal of Vincent and Penny
Granberg is GRANTED; and Land Use Permit 2030-89 is DENIED.
