SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Approve the Request for Qualification/Proposal (RFQ/P) for plastics recycling
and direct Staff to distribute the RFQ/P.
FINANCIAL IMPACT
None to the County. The resulting contract would be between the successful
bidder and the franchising agencies, collectors and/or recycling processing
centers who control the municipal solid wastestream in Contra Costa County.
REASONS FOR RECOMMENDATION/BACKGROUND
As mandated by AB 939, the cities and County of Contra Costa must divert at
least 25% of the waste from the landfill by 1995. As part of that effort, the
Plastics Recycling Task Force has recommended expanding curbside recycling to
include plastics. A demonstration program has been conducted in the City of
Walnut Creek under the auspices of the City, wTe Corporation and Dow Chemical.
wTe has now proposed the construction of a plastics recycling facility capable
of converting all rigid and mixed rigid plastics collected curbside into a high
grade polymer that can be manufactured into a wide range of commercial products.
To insure that we evaluate all plastics recycling efforts and to. avoid
duplication, the Plastics Task Force has recommended that the County develop a
Request for Qualification/Proposal (attached) . The RFQ/P has been reviewed by
the Solid Waste Commission and at a meeting of collectors, franchising agencies
and processing centers (all mayors, city council members, public managers,
sanitary districts and collectors were invited to the meeting) . In addition,
the plastics recycling issue was discussed twice at the Public Managers
Association, twice at the Mayors Conference and once at the Special Districts
Association.

REQUEST FOR QUALIFICATION/PROPOSAL FOR PLASTICS RECYCLING
GENERAL INFORMATION
Introduction
This Request for Qualification/Proposal (RFQ/P) is being issued by the Contra
Costa County Board of Supervisors on behalf of the franchising agencies,
collectors and recycling processing centers within Contra Costa County. The
RFQ/P is the first step in a selection process to designate a contractor that
will convert plastic waste collected through the residential curbside collection
programs into high grade ploymers that can be used in the manufacture of
commercial products.
Project Description
State law requires that at least 25% of the wastestream be diverted from
landfills by 1995 and 50% by the year 2000. Initial analysis indicates that
plastics constitute approximately 20-30% of the landfill volume and
approximately 8% of its weight. The franchising agencies of Contra Costa seek
to eliminate plastics from the wastestream.
Curbside recycling programs will be in place county-wide by the end of 1990.
Currently, one city collects plastics as part of its recycling program. It is
envisioned that plastics will be collected county-wide as part of the curbside
recycling programs and then deposited at transfer stations or processing
centers. Four such facilities are currently operating in the County. The
transfer stations/processing centers have the capability of compacting and
baling the plastics.
Results of RFQ/P
The recyclable wastestream in Contra Costa County is controlled by either the
franchising agency, the collector or by mutual control . To avoid duplication of
effort, a single RFQ/P process has been developed to identify a possible
qualified contractor to convert plastic waste into a form suitable for use in
the manufacture of commercial products. The outcome of this RFQ/P process will
be the development of a standard agreement between the successful proposer and
the franchising agency/collector.
GENERAL PROVISIONS
Expenses of Proposal Preparation. Each proposal prepared in response to this
RFQ/P shall be prepared at the cost and expense of the proposer and shall be
prepared by the proposer with the express understanding that there may be no
claims whatsoever for reimbursement from the County for the cost and the expense
of its preparation.
No Confidential Information. The proposal submitted in response to this RFQ/P
shall be public information. Technical or other data whose public disclosure
would cause substantial injury to the proposer's competitive position or
constitute a trade secret should not be included in this proposal .

QUALIFICATION PROCESS
Submittal Requirements. Any organization interested in submitting a proposal
for plastics recycling in Contra Costa County shall submit their proposal in
accordance with this RFQ/P to be received no later than 5:00 p.m. , ,
1990. Submittals must clearly state "Plastics Recycling Proposal" on the
envelope. Please forward proposals to:

Ten (10) copies of the proposal document, including the completed Proposal
Questionnaire, shall be submitted.
The County will date-stamp all materials received regarding the proposal
documents. Those received after the specified submittal deadline will be
rejected. Postmark time and date will not be usable as evidence for submittal
delivery time. The County will not be liable or responsible for any late
submittal for whatever reason.
Pre-Bid Conference. A pre-bid conference will be held at the County
Administration Building, 651 Pine Street, Martinez, at p.m. on ,
1990. County staff and members of the Plastics Task Force will review the
project and answer questions.

Selection Process and Schedule.
After the proposals have been initially reviewed by the designated Negotiating
Committee, a selection process and schedule will be prepared. All those who
submitted proposals will be notified of Committee directions and actions. The
final result will be a model agreement for use by the successful proposer and
the franchising agencies/collectors in Contra Costa County.
EVALUATION CRITERIA
The following three categories will be considered the primary elements in the
evaluation of the proposal documents.

Project Approach. Proposals will be evaluated on the feasibility of their
proposed approach to plastics recycling. Technical and marketing feasibility
will be key considerations, i .e. , ability to convert MSW plastic waste into a
high value form suitable for use in the manufacture of a wide range of
commercial products.
Experience. Proposers will be evaluated on their demonstrated ability to
finance, operate, and maintain successful solid waste processing operations,
recycling programs or other analogous operations. Overall management, marketing
and technical expertise will be important elements in the evaluation process.
Financial Stability. Proposers will be evaluated according to the following
financial criteria:
1. Overall financial condition, including ratings of corporate stock or debt
issues of the company by Standard and Poor's or Moody's Investors Service.
2. Long-term record of the proposer.
3. Financial ability to take on a project of this type and size based upon
past and current commitments.

2. Describe the type of organization (i .e. , public agency, corporation,

organizational background of the firm/agency.
3. List the officer or officers who will be responsible for negotiations and
duly authorized for signing contract documents or agreements relating to
this project.

4. If the proposer is a partially or fully-owned subsidiary of another entity,
indicate the company's participation in the proposer's activities, and
identify the levels of corporate management that will be needed to approve
contracts relating to this project.
SECTION B - TECHNOLOGY AND MARKETING
1. Describe the types of plastics which would be recycled (such as rigid,
mixed rigid, polystyrene, film, etc. ) .
2. Describe, if any, other materials which could be recycled at your proposed
facility.
3. Describe the plastics recycling process, including but not limited to the
method used to screen out contaminants, the process to separate plastic by
type, and the form of your recycled product.
4. Describe the market for the recycled plastic, including but not limited to
any existing contracts, marketing possibilities, types of products which
could be produced and limitations on use of your recycled product (due to
purity levels or other technical considerations) .
5. Describe any requirements as to acceptable levels of contamination of the
plastic by other materials or other specificaitons regarding the plastic
which you would receive.
6. Describe how you would assure that the plastic would be recycled over the
entire term of the contract.
SECTION C - PRELIMINARY RECYCLING PLANT PROPOSAL
1. To the extent known, describe the preferred volumes of plastics necessary
for plastic recycling, including any minimum feasibility thresholds.
2. To the extent known, list key milestones needed to reach plant operations,
including wastestream commitment, financing, and plant construction (if
necessary) . List status of each milestone.
3. Describe the anticipated/preferred role of the local solid waste collector/
processing facility in delivering or making the plastic available to your
facility.
4. Describe any possible property tax or sales tax benefit, if any, that would
accrue to the jurisdiction in which the plant is located.
5. Describe, to the extent known, any pollution that would be generated by
your facility.

SECTION D - RECYCLING, PROCESSING AND SOLID WASTE FACILITY EXPERIENCE
1. Provide all recycling, processing and other solid waste facility experience
or other experience relevant to plastics recycling including but not
limited to the number of years of experience and the degree of involvement
on each project relative to the following categories:
o Acquisition.
o Permitting.
o Design.
o Construction.
o Operation.
o Turnkey (i .e. , design plus construction)
o Full Service (i .e. , finance, design, construction, plus operation) . .
o Other activities.
2. Information provided should state the proposer's role on each project
(i .e. , designer, contractor, subcontractor, etc. ) . Identify those
presently under development as well as those already accepted and
operating. Each program or facility description should include:
o Location.
o Owner.
o Type of facility (transfer station, resource recovery facility, etc. )
o Size (i .e. , tons per day processed) .
o Solid waste characteristic (plastic, aluminum, ferrous metals, etc. ) .
o Capital costs.
o Development schedule.
o Project financing arrangements.
o Information regarding solid waste franchise contracts negotiated by
the firm.
o Information regarding the necessary permits, licenses or other
regulatory approvals for the project.
o References.
SECTION E - FINANCIAL CAPABILITY
The following information or equivalent shall be provided to demonstrate the
proposer's capability to meet its financial obligations for this contract. Any
affliction which may have a bearing on the ultimate financing of the project
must be identified.
1. Provide a copy of the firm's Form 1OKs filed with the US Securities and
Exchange Commission (SEC) over the past five years and all 1OQs since the
last 10k.
2. Firms or organizations not filing a Form 10K with the SEC should submit the
following information:
o Audited financial statements for the past five fiscal years to
include, at a minimum, income statement, balance sheet, and statement
of changes in financial position. (If less than five years available,
please provide to fullest extent possible. )

o Copies of quarterly financial reports issued subsequent to the last
annual report.
o A copy of the latest Annual Report, if any.
o Any material changes in the mode of conducting business, bankruptcy
proceedings, and mergers or acquisitions within the past five years.
o A list of the executive officers or directors, positions held, and
terms of office.
3. Describe all present obligations and their bearing upon the firm's
financial ability to meet the performance requirements of the proposed
recycling project.
4. Describe the business structure and funding scheme contemplated to
accomplish the goals of the proposed recycling project (joint
private/pub-lic agency, joint venture, limited partnership, corporation,
etc. ) .
SECTION F - OTHER INFORMATION
Provide any other information which you believe is relevant to your proposal and
would assist in proposal evaluation.
