SUBJECT: Hearing on Rezoning Application #2851-RZ, to rezone 5. 938 acres from
Single Family Residential District (R-6) to Planned Unit District
(P-1) , fronting approximately 1,000 feet on the north side of Camino
Andres, immediately west of the East Bay Municipal Utility District
aqueduct, west of Port Chicago Highway, in the West Pittsburg area,
filed by D & M Development (Applicants) and Yuan Ji Su and Chung Hsung
Chan (Owners) (APN 098-210-006) .
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve Rezoning Application#2851-RZ, along with Final
Development Plan #3025-89 and Subdivision 7375, as recommended
by the East County Regional Planning Commission, including
conditions attached.
3 . Adopt the East County Regional Planning Commission' s findings
as set forth in Resolution No. 22-1990, as the determination
for these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

This is the time heretofore noticed by the Clerk of the Board of Supervisors for
hearing on the above matter. Mary Fleming, Community Development Dept. , presented
the staff report. Supervisor Torlakson requested clarification on the disposition
on this proposal at the West Pittsburg Municipal Advisory Council. Karl Wandry,
Community Development Dept. , responded to Supervisor Torlakson' s question. The
Public hearing was opened and no one appearing in opposition, the public hearing
was closed. On recommendation of Supervisor Torlakson, . IT IS BY THE BOARD ORDEREr
that recommendations 1, 2, 3, and 4 are APPROVED; and as in recommendation 4,
Ordinance No. 90-34 is INTRODUCED, reading waived, and June 5, 1990 is set for
adoption of. same.

CONDITIONS OF APPROVAL FOR REZONING 2851-RZ AND FINAL DEVELOPMENT PLAN 3025-89
1. These development plans are approved as shown on plans dated November 1,
1989 as received by. the Community Development Department, except that Lots
9 and 25 shall be eliminated and the total number of units shall not exceed
28.
2. Prior to the issuance. of building permits, a landscape plan shall be sub-
mitted for the review and approval of the Zoning Administrator. The land-
scape plan shall include:
A. The size, species and location of plantings in all open space, common,
and patio areas.
B. Installation of. 30 15-gallon size street trees.
C. The landscape plan shall be prepared in conformance with Contra Costa
County Water Conservation policies.
D. Details of the size and location of any fences.
3. A color board shall be prepared for review and approval of the Zoning Ad-
ministrator indicating the proposed finishes, trims and paints to be used
on the exterior of the buildings.
4. A sign plan shall be submitted to indicate entry signs and individual
street numbers.
5. At least 30 days prior to filing of the final map, the applicant shall
submit three possible street names and numbers for review and approval by
the community Development Department Graphics Division.
6. An improvement plan indicating size, design, and location of street lights
shall be submitted for review and approval of the Zoning Administrator.
7. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement. Conformance with the
Ordinance includes the following requirements:
1. Constructing road improvements along the frontages of Camino
Andres and Anchor Drive. Constructing curb, 4-foot 6-inch side-
walk (width measured from curb face) , necessary longitudinal and
transverse drainage, and necessary pavement widening along the
frontage will satisfy this requirement.
a. The face of curb along Camino Andres shall be 16 feet from
the centerline of the road east of Anchor Drive and 20 feet
from the centerline to the west of Anchor Drive. The curb

along Anchor Drive shall be 20 feet from the centerline of
the road.
b. Camino Andres shall be widened out from the curb line a
width of 28 feet with a 3 foot graveled shoulder along the
southerly edge.
c. ' Anchor Drive shall be a 40 foot wide roadway. Anchor Drive
shall be barricaded at the north end of the site with an
acceptable barricade that will allow for pedestrian passage
while preventing vehicle passage, including motorcycles.
The barricade shall be designed so that it can be opened for
emergency vehicles.
d. The curve on the western end of the frontage shall have a
200 foot centerline radius. A .lesser radius may be approved
subject to the review and approval of the Public Works De-
partment.
2. Installing street lights on Camino Andres and Anchor Drive, The
final number and location of the lights shall be determined by
the County Traffic Engineer, and annexing to County Service Area
L-.100•for maintenance of the street lights.
3. Undergrounding of all utility distribution facilities.
4. Conveying all storm waters entering or originati.ng within the
subject property, without diversion and within an adequate storm
drainage facility, to a natural watercourse having definable bed
and banks or to an existing adequate storm drainage facility
which conveys the storm waters to a natural watercourse.
5.1 Designing and constructing storm drainage facilities required by
the Ordinance in compliance with specifications outlined in Di-
vision 914 of the Ordinance and in compliance with design stan-
dards of the Public Works Department.
6. Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
7. Submitting improvement plans prepared by a registered civil en-
gineer, payment of review and inspection fees, and security for
all improvements required by the Ordinance Code or the conditions
of approval for this subdivision. These plans shall include any
necessary traffic signage and striping plans for review by the .
County Traffic Engineer.
8. Relinquishing "development rights" over that portion of the site
that is within the structure setback area of the natural water-
course. The structure setback area shall be determined by using

the criteria outlined in Chapter 914-14, "Rights of Way and Set-
backs", of the Subdivis.ion Ordinance.
9. Installing, within a dedicated drainage easement, any portion of
the drainage system which conveys run-off from public streets.
B. Convey to. the 'County, by Offer of Dedication, additional right of way
on Anchor Drive as required for the planned future width of 60 feet.
The dedication shall include 20. feet radii right of way returns .at
Camino Andres.
C. Convey to the County, by Offer of Dedication, additional right of way
on Camino. Andres east 'of Anchor Drive as required for the planned fu-
ture width of 52 feet. .
D. Convey to the County, by Offer of Dedication, additional right of. way
on Camino Andres west of Anchor Drive as required for the planned fu-
ture width of 60 feet..
E. Submit a landscape plan for the frontages of Anchor Drive and Camino
Andres subject to the review of the Public Works Department and the
approval of the County Zoning Administrator
F. Relinquish abutter's rights of access along all curb returns within
the subdivision.
-G. Construct the onsite private roadway to County public road standards
and convey to the County, by Offer of Dedication, right of way as
shown on the Tentative Map. Additional area for utility placement, if
necessary, can be established via a public utility easement, subject
to the review and approval of the Public Works Department.
H. Complete the cul-de-sac at the end of Camino Andres by 'constructing
necessary pavement widening and conforming and curb and sidewalk.
I . Construct a 10 foot wide bicycle/pedestrian path along the northerly'
side of the existing Camino Andres roadway from the site easterly to
Port Chicago Highway with a curved alignment near Port Chicago High-
way.
J. Construct curb and sidewalk along the existing Camino Andres inter-
section with Port Chicago Highway.
K. Provide a 20 foot access easement from the Camino Andres cul-de-sac to
the East Bay Municipal Utility District right of way at the closest
point.
L. Submit a detailed conceptual plan of all offsite roadway . and pathway
improvements subject to the review and approval of the Public Works
Department.

M. Prior to issuance of building permits, file the Final Map for Subdi-
vision 7375.
ADVISORY NOTES
A. This project may be subject to 'the requirements of the Department of Fish &
Game. The applicant. should notify the Department of Fish & Game, P.O. Box
47, Yountville, California 94599, of any proposed construction within this
development that may affect any fish and wildlife resources, per the Fish &
Game Code.
B. The applicant will be required to comply with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the West Pittsburg Area of Benefit
and the East/Central County Travel Corridor Area of Benefit as adopted by
the Board of Supervisors.
C. The applicant will be required to comply with the drainage fee requirements
for Drainage Area .48B as adopted by the Board of Supervisors.
D. Applicant shall comply with the Park Dedication Fee Ordinance.
E. Certain improvements required by the Conditions of Approval for this de-
velopment or the County Subdivision Ordinance Code may be eligible for
credit or reimbursement against said fee. The developer should contact the
Public Works Department to personally determine the extent of any credit or
reimbursement for which. he might be eligible.
F. .-' Comply- with the requirements of the Fire District.

CONDITIONS OF APPROVAL FOR SUBDIVISION 7375
1. This subdivision Tentative Map is approved as shown on the revised Tenta-
tive Map dated as received by the Community Development Department on No-
vember 1, 1989, except that Lots 9 and 25 shall be eliminated and the total
number of units shall not exceed 28.
2. This subdivision is approved contingent upon approval of the rezoning re-
quest from R-6 to P-1.
3. Prior to recording the final map or issuance of Building Inspection De-
partment permits, submit a preliminary geotechnical report for review and
approval of the Community Development Department. Allow 45 days for re-
view.
4. The applicant shall submit landscape plans as required in Development Plan
3025-89 for the review and appy"oval of the Zoning Administrator. These
plans shall conform to Contra Costa County Water Conservation policies.
5. Comply with drainage, road improvement, traffic and utility requirements as
follows:
