Accept this report from the Community Development Department regardi.ng the letter from Central Sanitary District, dated March 15, 1990; the letter suggests that the Board appoint a member from the County to join the District-sponsored Regional Recycling Advisory Committee which the District is proposing will prepare the household hazardous waste and the waste composition components of the Integrated Waste Management Plan for a portion of the county. 2. Accept staff 's recommendation that the County should decline Central Contra Costa Sanitary District' s proposal for the District to prepare the waste characterization and the house- hold hazardous waste components of the Source Reduction and Recycling Element. for a portion of the unincorporated area of the .county because the study would not be completed in time for . the County to prepare the Source Reduction and Recycling Element as required under AB 939. (Assembly Bill 939 requires that the County prepare the Source Reduction and. Accept staff ' s recommendation that the Board decline Central Sanitary District'.s proposal to prepare the Household Hazardous Waste component ., for a portion of the unincorporated area of.. the county. 4. Accept staff ' s recommendation to defer the decision to participate in implementing a Household Hazardous Waste program which is designed to site a household hazardous waste collection facility, until the concept is further developed and . information (e.g. , public or private ownership of the facility, proposed county financial contributions and the status of private sector operations) are identified. 5.. Accept staff ' s recommendation to direct the Community Development Department to monitor the progress of :the Regional Recycling Advisory Committee, and to report back to the Board on a periodic basis as the concept of siting a . household hazardous waste collection facility develops so that the Board may determine,.. in consultation with the Hazardous Materials Commission and the Joint Committee on Household Hazardous Waste, the appropriate County involvement. 6 . Affirm that the County' s Joint Committee on Household Hazardous Waste has been successfully addressing the issue of household hazardous waste to develop countywide actions, and is completing Phase One of their Implementation Program and will begin to implement Phase Two of the program over the next few months. BACKGROUND/REASONS FOR RECO194ENDATIONS: On April 10 , 1990, the Board referred to the Community Development Department a letter from Central Contra Costa Sanitary District .(CCCSD) regarding the County Integrated Waste . Management. Plan. Their letter states that the CCCSD . is proposing to prepare, for the central county cities and the - unincorporated area of central county, the household hazardous waste and the waste characterization components of the Resource Recovery and Recycling Elements. The CCCSD suggests that the Board appoint a member of the County to join the Regional Recycling Advisory Committee if the Board decides to participate in their program. . CCCSD reports that they are also asking central county cities ' . and the, County to participate in the development of a household hazardous waste collection facility. CSD staff reports that their district is not proposing to prepare the household hazardous waste component of the Resource Recovery and Recycling Elements. Thus, this report addresses all three requests: 1 . Authorizing CCCSD to prepare the waste. characterization component for the unincorporated central county area; .2. Authorizing CCCSD to prepare the household hazardous waste component for the unincorporated central county area; and 3 . Authorizing County participation in an effort to site a permanent household hazardous waste collection . facility. 1 . Waste Characterization Study: Assembly Bill 939 requires the quantitative field analysis for the waste characteriza- tion study to be performed during the course of a year. CCCSD proposes to complete . the study by March 28, 1991 . Assembly Bill 939 requires that the County prepare the Source Reduction and Recycling Element (which includes a waste characterization component) by January 1 , 1991 . 41 3 . Cities must complete the element by July 1 , 1991. The CCCSD schedule would not allow the County to complete the element in sufficient time to meet the timeline of the current law. Section 41813 of the Public Resources Code authorizes the California Integrated Waste Management Board to . impose administrative penalties of up to $10,000 per day on any city or county which fails to submit an adequate . plan in accordance with the requirements of state law. Although staff believes that it may be efficient to join with other jurisdictions to prepare components of this element, the timeline of CCCSD would not allow the County to prepare our Resource Recovery and Recycling Element in sufficient time to meet the mandated submittal dates. In addition, Assembly Bill . 939 requires that the methodology of the waste characterization be uniform throughout the unincorporated area of the county. A waste characterization methodology that is designed to meet central county needs, may not prove applicable to the other unincorporated areas of the county. 2 . Household Hazardous Waste Component: CCCSD is proposing to prepare the household hazardous waste component for the unincorporated central county area. The County Hazardous Waste Management' Plan, which was. approved by the State Department of Health Services, includes a detailed analysis of household hazardous waste, as well as programs necessary to adequately address this issue. Following the recommendations of this Plan, the Joint Committee on Household Hazardous Waste, which is a combination of the County Solid Waste Commission and the . County Hazardous Materials Commission, was formed in January .of 1989 . The Committee developed a detailed work program, which they have been successfully implementing. Staff recommends that the County prepare the household hazardous waste component of our Source Reduction and Recycling Element rather than transferring this responsibility to the CSD for two reasons. First, the County has two advisory bodies with purview over household hazardous waste (the Hazardous Materials Commission and the Solid Waste Commission) . These two commissions have joined to form the Joint Committee on Household Hazardous Waste to address this particular issue. We believe that it is appropriate to continue to use these existing advisory bodies to address household hazardous waste. Secondly, County staff has developed substantial experience in addressing household hazardous waste issues through the preparation the Hazardous Waste Management Plan and the implementation of the work program of the Joint Committee on Household Hazardous Waste. Thus, the preparation of the household hazardous waste component can be most efficiently handled by existing County staff. 3 . Permanent Household Waste Facility: CCCSD Staff reports that the participation of the County in the Regional Recycling Advisory Committee would be for the purpose of joining with the central county cities and the Sanitary District to site a permanent household hazardous waste collection facility. According to their staff, decisions such as location, whether the facility would be publicly or privately owned, and financial commitments of participating jurisdictions have yet to be made. Since this program is in the conceptual stage, we recommend that the Board direct staff to monitor the progress of the Regional Recycling Advisory Committee, and to report back to the Board as this concept develops so that the Board may determine, in consultation with the Hazardous Materials Commission and the Joint Committee on Household Hazardous Waste, whether to participate in the siting of a facility.
