Contra FROM: Phil Batchelor, County Administrator os Costa County DATE: May 11, 1990 t�'9 CUUK�t SUBJECT: LEGISLATION: AB 4114 (Clute) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOYMMMATION Indicate that the Board of Supervisors continues to SUPPORT AB 4114 by Assemblyman Clute which would authorize the formation of a service authority for the abatement of abandoned vehicles and authorize the imposition of a $1. 00 fee on all registered vehicles to pay for the program. BACKGROUND: on April 3 , 1990 the Board of Supervisors voted to support AB 4114 by Assemblyman Steve Clute. On April 26 , 1990 the bill was amended. One of the highest priorities in the Board of Supervisors ' 1990 Legislative Program is the passage and enactment of legislation which would finance an abandoned vehicle abatement program. Assemblyman Clute has introduced AB 4114 (which has 20 co-authors, including Assemblyman Robert Campbell) , which would authorize a board of supervisors, by a 2/3 vote, and a majority of the cities having a majority of the population in the incorporated area of the county to establish a service authority which would plan and operate an abandoned vehicle abatement program. The board of supervisors and cities would also have to impose the additional fee on the registration of vehicles within the county. It is estimated that the $1. 00 fee would raise between $500,000 and $600 ,000 annually in Contra Costa County. The fee could be imposed effective January 1, 1992 , providing that the county and cities had approved: the ' imposition of the fee, the creation of the service authority and the plan prepared by the service authority and had submitted their plan to the California Highway Patrol. The fee could remain in effect only for a period of five years after the date on which the authority is established. The service authority ] would be disbanded after it had spent all funds raised by the increased registration fee. The April 26 , 1990 amendment requires a 2/3 vote by the board of supervisors, rather than a majority vote, to establish the authority and impose the additional registration fee. In view of the fact that funding an abandoned vehicle authority is such a high priority with the Board of Supervisors, it is recommended that the Board indicate its support for AB4114.
