SUBJECT: LEGISLATION: AB 3353 (Moore)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECONMU3NDATION
Indicate that the Board of Supervisors continues to SUPPORT AB
3353 by Assemblywoman Moore which would require that the Office
of Criminal Justice Planning institute three antihate crime
projects in three counties, one of which would be Contra Costa
County, for the purpose of establishing programs to provide
services to hate crime victims.
BACKGROUND:
On May 1 , 1990 the Board of Supervisors voted to support AB 3353
as it was introduced. On April 26 , 1990 the bill was amended.
Existing law authorizes cities and counties to establish a
commission on human relations and imposes various
responsibilities on a commission relative to fostering improved
relations between persons and groups of different races,
religions and nationalities within a community.
AB 3353 has been introduced by Assemblywoman Moore. As amended
April 26 , 1990, AB 3353 would revise some of these duties and add
to them the following:
1. To develop and administer programs and plans designed to
promote equal opportunity.

2. To cooperate with and assist in coordinating the work of
those agencies and organizations which are engaged in
fostering mutual understanding.
3 . To carry out any other assignment which the legislative body
deems appropriate.
AB 3353 also requires the Office of Criminal Justice Planning to
assist in establishing three antihate crime projects and
coordinate the exchange of information among the pilot projects.
Los Angeles County and Contra Costa County are named as sites for
two of the projects, with the third site to be named by the
Office of Criminal Justice Planning. Project's are to be
established in conjunction with existing human relations
commissions. Participation by the counties is voluntary.
Each project is to do the following:
1. Conduct a survey of cities and unincorporated areas in the
county to determine the availability of systems for
identifying and responding to hate crimes, . conflict
resolution programs and resources for assessing and
relieving racial, ethnic, religious and minority tensions.
2. Create a community task force including representatives of
ethnic and religious communities, schools and law
enforcement agencies to develop and implement a plan for
responding to hate crimes, develop and implement a plan for
assessing and relieving racial, ethnic, religious and
minority tensions, and develop and implement a plan for
coordinating the collection and maintenance of data on hate
crimes for the purpose of making reports to the Bureau of
Criminal Statistics of the Department of Justice. :
3 . Create a task force of school representatives to design and
introduce curricula on prejudice, racism and hate crimes in
the public school systems.
4. Establish community volunteer programs to provide services
to hate crime victims.
The bill requires each hatecrime project to submit quarterly
reports on its activities to the Office of Criminal Justice
Planning.
The bill also specifies criteria which will be used to measure
the success of each project.
The bill requires the Office of Criminal Justice Planning to
report to the Legislature by March 30, 1993 on the projects,
recommending a statewide system for responding to. and preventing
hate crimes.
AB 3353 is consistent with the hate crime prevention work which
is already underway under the direction of the ' Board of
Supervisors and the Human Relations Commission. Since AB 3353
would provide additional funding to continue the work of the
existing project it appears to be consistent with the wishes of
the Board of Supervisors in this regard. It is therefore
recommended that the Board of Supervisors indicate its continued
support for AB 3353 .
