FROM: Phil Batchelor, County Administrator o ,,s Costa May 11 19 9 0 9'`�' County DATE: y °'Tq cGuvt+ Lf� SUBJECT: LEGISLATION: SB 1830 (Cecil Green) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECONIlENDATION Indicate that the Board of Supervisors continues to SUPPORT SB 1830 by Senator Cecil Green which would permit a city, or county to adopt more stringent requirements than are reflected in the Uniform Building Code and Uniform Fire Code relating to fire and panic safety as are found to be reasonably necessary because of local climatic, geological or topographical conditions. BACKGROUND: On April 24, 1990 the Board of Supervisors voted to support SB 1830 . On April 24 , 1990 the bill was amended. The State Fire Marshal is charged undercurrent law with adopting fire and life safety standards for residential occupancies , including single family dwellings. This is done through the State Building Standards Commission. These adopted standards are considered to be minimum fire and life safety requirements. Many, if not most, communities within the State make amendments to these standards to address needs or concerns within their own city, county or fire district. These may be in the form of fire-safe roofing materials, built-in fire extinguishing systems, fire alarm systems and similar fire protection features. The Attorney General has issued an opinion indicating that local governments do not have the right to modify the State Building Standards on these .matters. As amended April 24, 1990, SB 1830 would clarify that cities and counties do indeed have the authority to adopt more stringent. standards relating to fire and panic safety which are found to be necessary because of local climatic, geologic or topographical conditions. This finding requires that the city or county have adopted the Uniform Building Code or the Uniform Fire Code or both. In this case the city or county could, by ordinance, adopt more. stringent requirements. The bill provides that any fire district which adopts the Uniform Building Code or the Uniform Fire Code or both such codes shall submit requests to amend those codes relating to fire and panic safety to any city or county wherein the amendments would apply. The governing board of the city or county would be required to approve or deny the request of' ' the fire district by majority vote. The bill excludes from a city, county or fire .,district' s authority to modify such standards, fire and panic safety requirements for the public schools which havebeen adopted by the State Fire Marshal. The bill also requires that an ordinance adopted pursuant to these provisions be made available for public inspection at the building department of any city or county where the. ordinance would apply. In addition the ordinance would have to be filed with the .State Buildings Standards Commission for informational purposes. The State Building Standards Commission would have no authority to approve or disapprove the ordinance. Chief William Maxfield of the Consolidated Fire District supports SB 1830 and recommends that the Board of Supervisors also support SB 1830 . In addition, the Board of Supervisors received a letter from Senator Green requesting support for SB 1830 . It is therefore recommended that the Board of Supervisors indicate its support for SB 1830 as amended April 24, 1990. cc: Senator Cecil Green County Administrator Chief,.
