HomeMy WebLinkAboutMINUTES - 05011990 - S.6 S. 6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 1, 1990 , by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson, Fanden NOES: None ABSENT: Supervisor Powers ABSTAIN: None ------------------------------------------------------------------ SUBJECT: SUB 7203 , Oakley, Access Issues Supervisor Tom Torlakson presented the attached report, dated May 1, 1990, relative to concerns raised by community residents related to construction traffic in the neighborhood adjacent to Subdivision 7203 . Mr. Torlakson recommended that a stop work order on the grading permit be issued until such time as the developer complies with the temporary access agreement. George Spier, representing the Seeno Company, advised that the developer has applied to CALTRANS for a temporary access permit. He stated that a stop work order would place a hardship on the developer and subcontractors, and expressed the developer' s willingness to work with the County to mitigate the impact on the community until such time as the temporary access permit is granted. Supervisor Robert Schroder commented on the hardship a stop work order would create not only for the developer but for ,the workers. He recommended that County staff contact CALTRANS and urge them to expedite issuance of the access permit. Victor Westman, County Counsel, recommended that the Building Inspector be directed to determine whether there are any violations prior to issuance of any stop work order on the grading permit. i Supervisor Nancy Fanden recommended that the County Administrator and Public Works Director contact CALTRANS relative to the access permit and report back to the Board later in the day. • Subsequently, the County Administrator advised that CALTRANS representatives had stated that the temporary access permit would be issued immediately. Supervisor Torlakson noted that some clean-up work on Carol Lane was necessary as a result of the recent construction traffic. Board members being in agreement, IT IS ORDERED that the Building Inspector is REQUESTED to monitor the clean-up activities on Carol Lane relative to access to Subdivision 7203, Oakley. Further, direct the Community Development Department and the Public Works Department to stop review of any development plans and maps until such time as developer assures compliance with regard to temporary access. Further, to ensure use of temporary access, direct the Public Works Department to immediately construct a temporary barricade at the northernmost end of Roberts Way and the easternmost end of Carol Lane to all through traffic until the completion 'of Subdivison 7203. BACKGROUND INFORMATION: Subdivision 7203 was approved by the Board of Supervisors and final conditions adopted on June 27, 1989 . At numerous times during the approval process, at local and county levels, residents of both Carol Lane and the Oakley Ranch development expressed extreme displeasure at the usage of Carol Lane or Charles Way to Roberts Way as access points to the new development. In an effort to distribute the additional traffic impacts equitably between the two neighborhoods, the Board took action to open both streets to provide access for the future residents of Subdivision 7203. On October 26, 1989, I met with Carol Lane residents, representatives of Public Works and Bellecci & Associates, the project engineer. As a result of that meeting, Public Works researched several questions the residents had posed. A great deal of concern was expressed by all residents regarding construction access to the site. In response to these concerns, the Public Works Department informed me (see memo dated November 29, 1989, attached) that the project engineer had negotiated and obtained temporary access through the Condon parcel to allow construction traffic to directly access the site off of Highway 4 . Based on these agreements and the Public Works memo, I wrote and distributed a letter (copy attached) to all residents of the area communicating the agreements . DEPUTY SUBDIVISION 7203 May 1, 1990 Page TWO On April 12th, my office began receiving scores of complaints from angry residents on Carol Lane and in Oakley Ranch about construction traffic on their streets. When contacted on that date, Mr. Bellecci advised that he would talk to Seeno and make sure instructions were given to construction truck drivers to use the temporary Condon access . It was as a result of dealing with the current barrage of complaints that my staff learned that the contractor had not submitted an application for a Caltrans permit for approval to use the Condon access prior to the commencement of grading and fill work at the site. During the next week, Caltrans ordered Seeno development to stop using the temporary access since they had not applied for a permit. The request for permit submitted by Seeno was received by Caltrans on Friday, April 20th. Caltrans has indicated that approval to use Highway 4 to the temporary access road will be granted, pending assignment of conditions to the permit. A representative of Public Works is now working with Caltrans to expedite the approval of the permit. In the meantime, trucks transferring fill to the site are disrupting the adjacent neighborhoods . Residents of the area have complained of substantial increase in noise, trucks operating at unsafe speeds, and disregard for the safety of children embarking and disembarking school busses . My office has been continually inundated with calls of complaints from extremely upset residents. This has required an extraordinary amount of staff time fielding complaints and monitoring the situation. Not only has the contractor not complied with the agreement to use the temporary access, but the contractor has not taken proper steps to ensure Caltrans approval of their permit prior to the grading and fill of the site. Diligent attempts by my staff and Milt Kubicek of the Public Works Department over the past two weeks to work with the developer to mitigate the impacts of this traffic have been unsuccessful. Michael Walford, Public Works Director SUBJECT: Carol Lane Meeting, Sub #7203, Oakley This is a follow up to the meeting at Carol Lane on October 26, 1989 in Oakley. During the meeting several items were brought up that my staff could not respond to at the time. Since then my department has researched these questions and provides the following answers. 1) Maintenance for the infiltration basin between Carol Lane and Teresa Lane. Our Maintenance Division has been notified of the problem. The basin has been cleaned in the past and Maintenance has said they will send a crew out to clean the basin again. Maintenance will also look at the possibility of placing gates at either end of the basin to prevent shopping carts, tires, and people from entering the basin. 2) Limiting access on Carol Lane and Robert Way for subdivision construction traffic. Our Road Engineering Division has called Frank Bellecci, the engineer for subdivision 7203, to start negotiating for temporary access through the Condon parcel. Frank has already talked with Condon, and Condon has agreed to a temporary access. The construction traffic will then access off State Route 4 through Condon's parcel and directly into sub 7203. This will alleviate construction traffic in the adjoining residential neighborhoods. 3) Highway 4 widening project. We are presently preparing plans to widen Highway 4 from Big Break Road to Empire Avenue. This project will include a total pavement width of 90 feet and right of way width of 110 feet. The County is presently negotiating with the property owners of the four parcels at Carol Lane and Highway 4 to obtain the extra right of way needed. Three structures are affected by the widening. The project will include frontage improvements (curb, gutter, and sidewalk) along Highway 4 for the four parcels. A sound study is currently under way to determine the need for a sound wall along Highway 4 at Carol Lane. The developer of sub 7203 (Seen) will be responsible for widening Carol Lane to a width of 28 feet. At the intersection of Highway 4, the December 19 , 1989 Page FOUR the basin again. Maintenance will also look at the possibility of placing gates at either end of the basin to prevent shopping carts, tires, and people from entering the basin. Residents should call Public works at 646-4184 if they are not satisfied with the clean-up or if new problems arise. If satisfactory results still aren't obtained, call Kathie Baladad in Supervisor Torlakson' s Office at 427-8138 . At the intersection of Highway 4, the pavement will be widened to allow for two lanes in the west bound direction with one lane in the east bound direction. The developer is not responsible for frontage improvements along Carol Lane. The ponding problem at the intersection of Carol Lane and Highway 4 will be resolved by the Highway 4 widening project. My office is assisting in petitioning Caltrans to expedite the Highway 4 Widening Project at Carol Lane. (Please see my attached letter and petition to Caltrans . ) This widening project on Highway 4 between Big Break Road and Oakley Road will include the installation of a raised median with some attractive landscaping. (5 ) Striping on Highway 4 : The residents requested that striping on Highway 4 be changed. The striping in front of the new Raley's Shopping Center was changed with their road widening project.
