Costa DATE: May 1, 1990 SUBJECT: Confirming .Existence of a Local Emergency SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Confirm action taken by the County Administrator, as Administrator of Emergency Services, proclaiming a local emergency throughout the county, including all cities therein, as a result of the earthquakes which struck the South/Central area of the county beginning at 9:41 p.m. on April 27, 1990. BACKGROUND At 9 :41 p.m. on April 27, 1990, an earthquake measur,i_nw6 on the Richter scale and centered in the Alamo area struck Contra Costa County. A second quake struck struck at 9:47 p.m. in the same area. As a result, many homes in the immediate vicinity of the Round Hill Country Club incurred moderate damage. County Building Inspection staff reviewed-*.;63,:---homes on Saturday, April 28 . Total estimated damage of the homes reviewed so far is $278, 000. Requests for inspections are still being received and damage data being collected. As the Administrator of Emergency Services and under authority granted to me by Ordinance Code Section 42-2 . 802 , I proclaimed a local emergency at 12 : 15 a.m. on April 28, 1990. This action allows the county to apply for any state financial assistance that may become available and allows the Board to request the Governor to proclaim a State of Emergency, if needed. Based on damage reports. submitted to date, it does not appear that damage was extensive enough to meet the eligibility requirements for either State or Federal financial assistance and there is no need at this time, to request a Governor's declaration. Staff of the County Office of Emergency Services will review additional 'damage data to determine if a request for financial assistance can be justified in accordance with State and Federal regulations. Nancy C.Fanden.2nd District Robert I.Schroder,3rd District Sunne Wright McPeak,4th District Tom Torlakson,5th District .sly-count' PROCLAMATION CONFIRMING EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Ordinance Code Section 42-2.802 of the County of Contra Costa empowers the County Administrator, as the Administrator of Emergency Services to proclaim the existence of a local emergency when said county is affected or likely to be affected by a public calamity and the Board of Supervisors is not in session, subject to ratification by the Board of Supervisors within seven days; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within this county caused by earthquakes commencing on or about 9:41 p.m. on the 27th day of April, 1990, at which time the Board of Supervisors of the County of Contra Costa was not in session; and WHEREAS, said Board of Supervisors does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency; and WHEREAS, the County Administrator did proclaim the existence of local emergency within said county at 12:15 a.m. on the 28th day of April, 1990. NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the Board. PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Ordinance Code Section 42-2.802 of the County of Contra Costa empowers the County Administrator, as the Administrator of Emergency Services to proclaim a local emergency when said county is affected or likely to be affected by a public calamity and the Board of Supervisors is not in session; and WHEREAS, the County Administrator of the County of Contra Costa does hereby find: That conditions of extreme peril to the safety of persons and property have arisen within said county, caused by earthquakes of 4.6 and 4.3 Richter Magnitude which occurred at 9:41 p.m. and 9:47 p.m. on April 27, 1990 in the Alamo area; and That the Board of Supervisors of the County of Contra Costa is not in session (and cannot immediately be called into session) : NOW, THEREFORE, IT IS HEREBY PROCLAIMED at 12:15 a.m. , April 28, 1990, that a local emergency now exists throughout said county; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this county shall be those prescribed by state law, by ordinances, and resolutions of this county, and by the County of Contra Costa Emergency Plan, as approved by the Board of Supervisors in May, 1987. ton Phil Batchelor, County Administrator
