HomeMy WebLinkAboutMINUTES - 05011990 - S.3 - 53 TO: BOARD OF SUPERVISORS FROM: Contra Supervisor Tom Torlakson Costa DATE: May 1, 1990 County SUBJECT: IMPOSITION OF MORATORIUM IN THE MORGAN TERRITORY AREA SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: 1 . Direct County Counsel and the Community Development Director to complete the necessary official documents for the imposition of a moratorium on any new general plan amendments, any new subdivisions, and any new land use permits in the Morgan Territory area. This moratorium shuold be in force until the zoning study is completed and its recommendations incorporated in the new Countywide General Plan. 2 . Set May 15, 1990 at 2 p.m. , for a public hearing on this matter and decision. 3 . Commence immediately with the zoning study referenced below and financed by Moutanin Meadows II . Complete this study by the time the new Countywide General Plan is to be adopted so the study's recommendations and policies can be incorporated into the new General Plan. 4 . Direct Community Development staff to notify community groups and property owners in the area as well as the City of Clayton, the Marsh Creek Association and Save Mt. Diablo. BACKGROUND INFORMATION: The issue of completing the zoning studies called for Morgan Territory General Plan Amendments have come up several times . When the Morgan Territory General Plan was adopted, it allowed for the Mountain Meadows II project which was recently affirmed again by the Board of Supervisors in its approval action of April 10, 1990, but it pointedly called for a further development of guidelines to regulate future growth in- the area. The Mountain Meadows II project is conditioned to finance this long-awaited zoning study. The work on the study should begin immediately. It should include an examination of slope density zoning ordinance approaches and restrictive ridge top/view shed guidelines. The Planned Unit Development zoning appr9ach should be strongly considered, too, in order to allow more flexible planning to fit topography and habitat conditions and avoid the "cookie-cutter" approach.
