Use of Marsh Canyon Landfill Condition SUBJECT: of Approval 36. 4 Monies ST'S couzi' SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMM]MATIONS 1. Authorize the Community Development Department to expend the Condition 36 . 4 monies for short-term ( "action" ) resource recovery related efforts. 2. Concur with the Community Development Department that the Condition 36 .4 monies should be used in conjunction with the Acme Transfer Station Condition 12. 9 monies to support the County' s short-term ( "action" ) program for resource recovery. 3 . Refer to the Environmental Affairs Committee for review of implementation proposals. FINANCIAL IMPACTS 1. None, on existing County revenue sources. 2. The recommendations would result in funding the County' s resource recovery action program from monies provided by disposal facility permittees, and funding AB 939 and other long-term solid waste management programs from the tipping fee surcharge. BACKGROUND The $200,000 annual fee established by Land Use Permit 2010-90 Condition of Approval 36. 4 for the Marsh Canyon Sanitary Landfill project became effective on April 1, 1990 (the first annual payment has been deposited) . The annual fee is to be used for a "resource recovery program. " In effect, the fee complements. the $100,000 annual fee imposed on the Acme Waste Recovery and Transfer Station project in 1987 (LUP 2122-86, COA 12. 9) which enabled the County to hire its Resource Recovery Specialist and become more active in the resource recovery field. CLERK OF THE BOARD OF Health Services Department SUPERVISORS AND COUNTY ADMINISTRATOR Sheriff's Department General Services Department M382%7-83 Solid Waste Commission BY .DEPUTY .e The new fee monies have become available at a time when the County is legally obligated to expand its solid waste planning program to comply with the planning mandates of AB 939, and at a time when it is prudent for the County to expand its action programs in order to be able to meet the waste reduction objectives (a 25% reduction by 1995; a 50% reduction by 2000 ) which AB 939 mandates to be met through the new City and County Integrated Waste Management Plans. Consequently, staff proposes to use the monies available from the tipping surcharge (now $ .95 per ton) for establishing and carrying out the AB 939-mandated planning process, and to use the approximately $300,000 available from the solid waste facilities ' fees for the conduct of the resource recovery action program outlined below. It is noted that AB 939 generally allows the tipping fee surcharge ( formerly restricted to planning) to be used for action programs to implement the new plan once it is adopted. Also, the Condition 36. 4 fee is to be reviewed when the Board considers a franchise agreement; the Board may wish to re-allocate the fee/franchise fee monies at that time. In general terms, staff proposes to apply the $300 , 000 to the following program components: County (Internal) Programs - County Building Recycling - Detention Facility Waste Processing - Supply Procurement Guidelines Unincoporated Area Programs - Unincoporated Area Franchising - Curbside Recycling Action Component Development - Commercial/Industrial Recycling - Yard Waste Composting - Wood Waste Utilization - Waste Paper Recycling (Market Development) - Plastics Recycling (Task Force Participation) - Litter Control (Assist Health Services Department) - Household Hazardous Waste Control (Assist Health Services Department) - Recycled Material Market Development - Packaging Reduction - Market Development Outreach and Public Information Program Development - School Program - Recycling Corps - Promotion (Hotline) The proposed work programs, budgets and priorities for these items are being developed in conjunction with the proposed budget for AB 939 planning work. It is noted that almost all of the program components are on-going efforts or efforts that will take several years to accomplish. Although the intention is to address all of the items between now and the end of the FY 1990-91 fiscal year, time, budget, and AB 939 coordination will require prioritization. The $300,000 action program will, of course, cover the salary of the Resource Recycling Specialist and the expenses of her office, as well as the costs of other employees assigned (typically, part-time) to work on the components. 2.
