Adopted this Resolution on May 1, 1990 by the following vote:
AYES: Supervisors Schroder , McPeak, Torlakson and Fanden

ABSENT: Supervisor Powers
ABSTAIN: None RESOLUTION NO. 90/260
SUBJECT: Approval of the Final Map, Subdivision Agreement and Road
Improvement Agreement for Subdivision 7099, Alamo Area.
The following documents were presented for Board approval this
date:
The Final Map of Subdivision 7099, property located in the
Alamo area, said map having been certified by the proper officials.
Said map was accompanied by:
I. A Subdivision Agreement with Thomas Barry Construction, Inc. ,
subdivider, whereby said subdivider agrees to complete all
improvements as required in said Subdivision Agreement within
one year from the date of said agreement.
Said agreement was accompanied by security to guarantee the
completion of road and drainage improvements as required by
Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 171804, dated
April 12, 1990) in the amount of $1, 000 made by Thomas
Barry Construction, Inc.
B. Additional security in the form of a letter of credit
dated April 19, 1990 issued by The Bank of San Ramon
Valley (Letter of Credit No. 1036) with Thomas Barry
Construction, Inc. as principal, in the amount of $93, 600
for faithful performance and $47, 000 for labor and
materials.
II. Road Improvement Agreement for the off-site Miranda Creek
improvements at Ersilia Trail with Thomas Barry Construction,
Inc. , whereby said subdivider agrees to complete all
improvements as required in said Road Improvement Agreement
within one year from the date of said agreement.
Said Document was accompanied by security to guarantee the
completion of road and drainage improvements as required by
Title 9 of the County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 171804, dated
April 12, 1990) in the amount of $1, 000 made by Thomas
Barry Construction, Inc.
B. Additional security in the form of a letter of credit
dated April 19, 1990 issued by The Bank of San Ramon
Valley (Letter of Credit No. 1035) with Thomas Barry
Construction, Inc. as principal, in the amount of $51,300
for faithful performance.

Agreement for Subdivision 7099, Alamo area.

III. Letter from the County Tax Collector Stating that there are no
unpaid County taxes heretofore levied on the property included
in said map and that the 1989-90 tax lien has been paid in
full and 1990-91 tax lien, which became a lien on the first
day of March, 1990, is estimated to be $1,400;
IV. Security to guarantee the payment of taxes as required by
Title 9 of the County Ordinance Code in the form of a cash
deposit (Auditor's Deposit Permit No. 171652, dated April 10,
1990) made by Ersclia L.P. in the amount of $1,400 guarante-
eing the payment of the estimated tax;
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and
this Board does not accept or reject on behalf of the public any of
the streets, paths, or easements shown thereon as dedicated to
public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement and
Road Improvement Agreement are also APPROVED.
I hereby certify that this is a Crus and correct copy of
an action taken and entered on the minutea of the
Board of Supervisorsn the date shown.
