SUBJECT: ACCEPTING THE ASSESSMENT DISTRICT SCREENING COMMITTEE'S
RECOMMENDATION THAT THE BOARD APPROVE FORMATION OF ASSESSMENT
DISTRICT 1990-1 BASED ON THE FOLLOWING CONDITIONS:
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
ACCEPT the Assessment District Screening Committee's recommendation that the Board
approve formation of Assessment District 1990-1 based on the following conditions:
1. In determining the acquisiton price, the construction cost component shall
not exceed the lesser of:
(a) The amount of the surety bonds required of the developer by the County
(or other public agencies where applicable), or
(b) The amount actually paid to the construction contractor, as determined by
invoices together with evidence of payment submitted to the Engineer of
Work.
2. The Engineer of Work shall certify compliance with paragraph 1 (b).
II. Financial Impact:
None to County.

III. Reasons for Recommendations and Background:
The Smith Land and Development Company is requesting approval for the formation of an
Acquisition Assessment District to acquire public improvements such as roadways, water
facilities, sewer and other applicable improvements completed by the developer. The formation
of such a district will offer the homeowner the efficiencies of private construction and the cost
savings of public financing. It is felt that a uniform assessment over the entire project would
more equitably spread the costs and benefits of the project to all homeowners.
Because of the tight construction schedule resulting from late project approval, there is
insufficient time to set up a regular construction assessment district. However, the use
of an acquisition assessment district will still provide all of the benefits without the need
for delays in the construction schedule.
IV. Consequences of Negative Action:
Will penalize homeowners because of unequal distribution of costs and benefits arising
form the need to phase the project in two phases.
