MICHAEL WALFORD, CHIEF ENGINEER DATE: May 1, 1990 SUBJECT: DRAINAGE AREA 40A - LINE B Project No.: 7565-6D8451 Task: ACQ Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Amendment to Right of Way Contract from Pleasant Hill Free Will Baptist Church. B. AUTHORIZE Chief Engineer to execute said Amendment on behalf of the District. C. APPROVE payment of $400 for said property rights and AUTHORIZE the Auditor- Controller to issue a check in said amount payable to Pleasant Hill Free Will Baptist Church. II. Financial Impact: Payment of $400 from Drainage Area 40A funds. III. Reasons for Recommendations and Background: The installation of the storm drain line required the removal of trees and miscellaneous landscaping which were not valued in the original appraisal. IV. Consequences of Negative Action: The owner will have a cause of action against the District for failure to pay compensation as required by law.
