HomeMy WebLinkAboutMINUTES - 05011990 - 1.10 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on May 1, 1990 by the following vote: AYES: Supervisors Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: Supervisor Powers ABSTAIN: None RESOLUTION NO.90/261 SUBJECT: Approval of the Final Map and Subdivision Agreement for Warranty Period and Deficiency Deposit for Subdivision 7129, Byron Area. The Public Works Director having notified this Board that the improvements for 7129, being developed by Bar-C Properties have been completed except for minor deficiencies and that such improvements have been constructed without the need for a Subdivision Agreement; The following documents were presented for Board approval this date: The Final Map of Subdivision 7129, property located in the Byron area, said map having been certified by the proper officials. A Subdivision Agreement for warranty period with Bar-C Properties , subdivider, whereby said subdivider agrees to satisfy any valid claims of liens of labor and materials as to the said improvements and subdivision appearing hereafter upon demand by the county as required in said Subdivision Agreement for Improvement Warranty within six months from the date of said agreement. Said documents were accompanied by: I.' Security to guarantee the completion of minor road and drainage deficiencies as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 172080, dated April 18, 1990) in the amount of $1, 100 made by Bar-C Properties. B. Additional security in the form of a cash deposit (Auditor's Deposit Permit No. 172080, dated April 18, 1990) in the amount of $16,995 made by Bar-C Properties. II. Security for labor and materials for the six month lien guarantee period as required by Title 9 of the County Ordinance Code, in the form of a cash deposit (Auditor' s Deposit Permit No. 172080, dated April 18, 1990) in the amount of $57,200 for labor and materials made by Bar-C Properties. III. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and the 1990-91 tax lien, which became a lien on the first day of March, 1990, is estimated to be $10,700. IV. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code, in the form of a cash deposit (Auditor's Deposit Permit No. 172022 dated April 17, 1990) made by Bar-C Properties in the amount of $12, 000 guaranteeing the payment of the estimated tax; RESOLUTION NO. 90/261 Approve Final Map and Subdivision Agreement for Subdivision 7129 May 1, 1990 Page 2 of 2 NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. BE IT FURTHER RESOLVED that the improvements have been completed except for minor deficiencies as of April 19, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty. BE IT FURTHER RESOLVED that the $57,200 cash security for labor and materials (Auditor's Deposit Permit No. 172080, dated April 18, 1990) deposited by Bar-C Properties be RETAINED for the six-month lien guarantee period until October 15, 1990, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file.
