SUBJECT: Hearing On Appeal Of Smith Companies From Administrative
Decision By Community Development Department Relative To
Subdivision 7109, Danville/Alamo Area.
This is the time for the hearing on the appeal of Smith Companies
from the administrative decision by the Community Development
Department for the setback requirements for a proposed single family
residence on lot, 6 of Subdivision 7109 in the Danville/Alamo area.
Karl Wandry, Community Development Department; presented the
staff report on the appeal before the Board today, commenting on the
staff determination on the setback requirement and: he described the
option$ available to the Board. He advised of the staff
recommendation to deny the appeal and direct the applicant to either
pursue a variance or to redesign the lot to accommodate the house with
the twenty foot setback.
The public hearing was opened and the following persons appeared
to speak:
Mike Davis, 111 Piedras Court, Danville, representing the Smith
Company, requested that the Board overturn the staff decision.
Nola Pear, 1921 Green Valley Road, Danville, representing the
Green Valley Homeowners' Association, requested that the Board uphold
its decision for six homes with no variances.
David Meyer, Crosby, Heafey, Roach and May, 1999 Harrison Street,
Oakland, representing Mr. and Mrs. David Radin who: live at 1923 Green
Valley Road, spoke in opposition to the appeal.
Mr. Davis spoke in rebuttal.
The public hearing was closed.
Supervisor Schroder indicated that after listening to the staff
and the testimony today, he would request a week to review the matter.
He requested clarification from staff on the dedication of the trail.
Mr. Wandry responded to Supervisor Schroders .request.
On recommendation of Supervisor Schroder, IT IS BY THE BOARD
ORDERED that the decision on the . above appeal is DEFERRED to the May
22, 1990 Determination Calendar.
