BACKGROUND:
Each month the County' s Construction Manager for the West County
Justice Center, Marsh Creek Detention Center and Martinez
Detention Facility, O'Brien-Kreitzberg & Associates, Inc. , files
a progress report with the County on the work they are
supervising on the construction of the West County Justice
Center, Marsh Creek Detention Center and the Main Detention
Facility in Martinez . Progress Report # 19 for February, 1990
notes, in regard to the West County Justice Center, that the
budget of $1. 9 million for furniture, equipment and signage does
not appear adequate for the items specified. ' The Sheriff ' s
Department is evaluating the potential for other funding sources
and is looking at budget cutting measures required to stay within
budget. A time extension of 33 days has already been approved.
A request for a time extension of an additional 45 is pending.
The forecast completion date is now June 26, 1990.
In regard to the Main Detention Facility in Martinez, the
Progress Report notes that the State Fire Marshal and the Board
of Corrections have approved the construction documents. The
Architect and Project Manager are completing a final review of

the corrected drawings and assembling the front end documents of
the specifications. These corrections will be completed in
March. The construction period is now projected to be 180 days.
Work within F-module is scheduled to occur over a 42 day period
and work within M-module is scheduled to occur over a 63 day
period. These modules will be partially occupied during
construction.
In regard to the Marsh Creek Detention Facility, the Progress
Report notes that miscellaneous "punch list" and warranty work is
ongoing, albeit very slowly. The Contractor. was put on notice
January 22, 1990. He was notified that if the work was not
completed quickly, final corrections will be done by others and
paid from remaining project retention. Although ,some. corrective
work was done, there is no indication that it is a serious
effort.
Overall, construction work at the three facilities is $1,957,695
under the original estimates.

Comment: The deficit in the contingency is based on negotiated and pending
changes through February. It is estimated that approximately $800,00
in contingency will be needed which is reflected in the budgeted

Comment: The Contractor has claimed $159,054 and 91 days due to county code
changes. Through negotiations with the Construction Manager, the
Contractor is now willing to settle for a 45 day time extension but no
dollars which is being considered by the County.
MARTINEZ DETENTION FACILITY

Comment: The environmental review documents must be completed by'the Community
Development Department before the project can be scheduled on the
Board of Supervisor's agenda.

Comment: The State Fire Marshal approved and stamped the drawings. The
Architect is making final corrections and the Project Manager is
preparing the contract boilerplate, including Notice to Contractors
and instructions to Bidders. Final corrections will be, completed in
March at which time the project will be forwarded to the Board of
Supervisors to authorizing bidding.

A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Brief and
Summary, 2) Detailed Schedule and Financial. Information and 3) Attachments.
It describes the design and construction progress as well as Areas of
Concern for the West County Justice Center, Marsh Creek Detention Facility
and Martinez Detention Facility achieved during the period of February 1990.

a. Revised Environmental Impact Report
The final chapters of the corrected Administrative draft EIR were
submitted in February and are currently being reviewed ; by the
Community Development Department, Counsel and the Project Manager.
b. WCJC Advisory Group
The next meeting of the Advisory Group is .scheduled for March 7.
The meeting will be held at the site.

^The Contractor has requested a 45 day time extension in order
to incorporate changes required by the County interpretation of
the fire separation ratings in the housing units.
2. Marsh Creek Detention Facility
a. Construction

In response to County threats, miscellaneous "punch list" and
warranty work has subsequently resumed. If progress is not
satisfactory, the Contractor's bonding company will be notified and
the retention will be used by the County to make final repairs.
3. Martinez Detention Facility
a. Design
The project will be issued for bid in April. Construction is
scheduled for 180 days.

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
♦ Contract B: Walsh Construction Company
a. Light Fixtures, Building 4:
Issue: There is not enough room between the ceiling and diffuser
above the lavatories in Building 4 cells for the light fixtures.
Action: The Construction Manager has directed the
Contractor to install the lights in a similar cell
for a test mock-up to _determine _if . the lights will
meet the bid of correction standard of 20 F.C.
b. Electrical and Gas:
Issued: The County Building Inspection Department refused to
allow PG&E to turn on the permanent power and gas. This could
impact the completion of the project and result in a claim from
the contractor.
Action: The Construction Manager has scheduled a meeting with
the County to work out an equitable settlement. In addition, the
Construction Manager requested a power -plan from the contractor.
C. Topsoil Stockpile:
Issue: It is estimated there will be approximately 8500 CY of
topsoil remaining after the Contractor finishes spreading the
topsoil he needs for the project. The remaining topsoil will
interfere with the exterior light poles.
Action: The Construction Manager directed the Architect to
explore disposal of the topsoil on and off site. The
Construction Manager will estimate the impact.
d. Return Air Ducts:
Issue: The State Fire Marshal agreed to allow the use of gypsum
wallboard ceilings for the plenum returns. The County Building
Inspection Department took a more stringent interpretation and is
requiring a one-hour rating of these ceilings.
Action: The Construction Manager is working with the Architect
to find an acceptable solution.

e. Food Cart Changes:
Issue: Food Cart prices were received based upon the
specifications. The price of one .bid was almost $70,000 less
expensive, but the carts were 4 inches longer than the
specification allowed.
Action: The Construction Manager asked the Architect and the
County to assess the affect the addition 4 inch length has upon
operations and storage capacity. The Architect and County agreed
that the 4 inch increase was. acceptable.
f. Fencing:
Issue: The non-climbable fence was tested by the Sheriff's SWAT
team. The Sheriff's Department concluded it failed to provide
the required security.
Action: The Architect states that the fabric is only one portion
of the total security system. The Construction Manager directed
the Architect to develop alternatives for County consideration.
g. County Code Change Claim:
Issue: The Contractor has made allegation that the
interpretation of fire separations made by the County Building
Inspection Department has cost them 91 days and $159,054. The
Construction Manager denied the claim. The Contractor has
offered to settle the claim for a 45 day non-compensable time
extension.
Action: The Construction Manager evaluated the offer and has
recommended acceptance of the settlement.
h. Schedule:
Issue: The Contractor's progress continues to slip. They are
currently behind the May 12 completion date by approximately 45
days.
Action: The Contractor's delays are due to a lack of manpower
and finishes which is delaying follow-on trades. The Contractor
has hired a new subcontractor for painting and more 'personnel
have been brought on-board. The Contractor states delays are
due, in part, to code changes.
i. Water Repellant:
Issue: The substitute water repellant failed to meet moisture
tests and was rejected.
Action: Contractor was directed to use the specified material. A
meeting was held with the supplier and contractor and additional
tests are to be performed.

j . Dead Bolt Locks:
Issue: Sheriff is questioning dead bolt locks for housing units.
Action: It was determined that the dead bolt locks are according
to the original program.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: '1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into design and
construction phases. The design portion will include general design data
and a progress narrative. The construction section will be subdivided by
each contract and will provide contract data, a progress narrative, and a
bar chart.
2. West County Justice Center
a. Design
The budget of $1,900,000 for furniture, equipment and signage does not
appear adequate for the items specified. The Sheriff's Department is
evaluating the potential for other funding sources and is looking at
budget cutting measures required to stay within budget. ;.A major
savings will be the substitution of metal inmate beds for originally
specified wood beds.
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract A), which is substantially complete.
2) The second contract is for the construction of the detention
facility (Contract B).

FINANCIAL ANALYSIS
1. General:
The detailed financial report is divided into three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The projects are further divided into the Design and
Construction phases. The Design portion will include a narrative. The
Construction section will be subdivided by each contract and will provide
contract data, where available, narratives and cost curves.
2. West County Justice Center
a. Design:_
The Architect's basic fee is $2,494,423 of which $2,363,135 (94%) has
been paid. In addition, the Architect has been authorized $616,426 for
extra services, of which $541,130 (87%) has been paid.
b. Construction:
The West County Justice Center financial report includes two contracts:
1) The first contract is for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is $2,415.
2) The second contract is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $(244,092).

A cost curve is attached, comparing the actual progress (cumulative actual
value of work completed and materials delivered to site) as of February 25,
1990 to the Contractor's forecast of progress. The Contractor's forecast
(early start and late start) is based on the values assigned to individual
activities in the Contractor's 9/25/89 revised baseline schedule.
The actual value of base contract work completed to date is $24,972,704 for
change orders, it is $657,009. The total value to date becomes
$25,629,713.
