SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Adopt a position of SUPPORT IF AMENDED in regard to AB 3983 by
Assemblyman Filante which would reduce from not less frequently
than five years to not less frequently than four years the period
of time within which the Department of Corporations is required
to conduct an on-site medical survey of the health delivery
system of each health care service plan.
BACKGROUND:
Under existing law (the Knox-Keene Health Care Service Plan Act
of 1975) the Department of Corporations is required to conduct an
onsite medical survey of the health delivery system of each
health care service plan and specialized health care service plan
as often as is deemed necessary to assure the protection of
subscribers and enrollees, but not less less frequently than once
every five years.
Assemblyman Filante has introduced AB 3983 which, as introduced,
would reduce this time period from five years to four years.
The Contra Costa Health Plan Advisory Board has recommended that
the Board of Supervisors request an amendment to AB 3983 and if
the bill is amended as recommended that the Board of Supervisors
support it.
The Contra Costa Health Plan is subject to onsite audits not only
by the Department of Corporations but also the State Department

health care service plan.
In the past both state agencies have tended to conduct their
audits with little awareness of ' the other agency, thereby
duplicating each other' s audits and creating a disruptive
situation for CCHP staff. The CCHP Advisory Board recommends an
amendment to AB 3983 which would indicate than in the year in
which the State Department of Corporations conducts an onsite
medical survey of the health plan, that survey would also serve
as the audit which would otherwise be. done by the State
Department of Health Services.
It appears reasonable to request such an amendment and it is
therefore recommended that the Board of Supervisors indicate its
support for AB 3983 if the bill is amended as requested by the
CCHP Advisory Board.
