SUBJECT: LEGISLATION: SB 2823 (Garamendi)
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Adopt a position in SUPPORT of SB 2823 by Senator Garamendi which
would repeal the sunset date for the dispute resolution program,
thereby allowing it to continue indefinitely.
BACKGROUND:
Existing law provides for the establishment of a Dispute
Resolution Advisory Council in the Department of Consumer Affairs
and for dispute resolution programs to be operated pursuant to
contract by counties which desire to participate in such programs
under specified circumstances. This law is currently scheduled
to be repealed January 1, 1992. The law requires that in order
to be extended, a law be enacted by January 1, 1991 which extends
or repeals the sunset date.
Senator Garamendi has introduced SB 2823 which, as introduced
March 2, 1990, would simply repeal the January 1, 1992 sunset
date and thereby extend the dispute resolution program
indefinitely.
The County' s Human Relations Commission recommends that the Board
of Supervisors indicate its support of SB 2823 on the basis that
the Commission is currently receiving funding from the dispute
resolution program. This office concurs in that recommendation.
