Phil Batchelor, County Administrator County DATE: May 7, 1990 SUBJECT: LEGISLATION - SB 2028 (Doolittle) SPECIFIC REQUEST(S)OR RECOMMENDATION($)&BACKGROUND AND JUSTIFICATION RECONIlEENDATION Indicate that the Board of Supervisors continues to SUPPORT SB 2028 by Senator Doolittle which would add specified stimulants to the list of controlled substances . for which possession of instruments used for injecting, ingesting or smoking these substances is unlawful. BACKGROUND: On March 13 , 1990 the Board of Supervisors voted to support SB 2028 by Senator Doolittle. The bill has now been amended. Existing law provides that it is unlawful to possess any instrument or paraphernalia used for unlawfully injecting or smoking certain specified controlled substances. Senator Doolittle has Introduced SB 2028 which adds certain stimulant's to this list and thereby makes it unlawful to possess any instruments used to inject or smoke these substances. In addition, SB 2028 adds . instruments used to ingest these substances. Since SB 2028 appears to make it more difficult to possess instruments which allow an individual to inject, ingest or smoke controlled substances the bill assists in furthering the Board of Supervisors' war on drugs. It is therefore recommended that the Board of Supervisors indicate its continued support for SB 2028 .
