HomeMy WebLinkAboutMINUTES - 05151990 - 1.15 1. 15 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 15, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Closure of a portion of Sunset Road, Brentwood Area The Public Works Director reported that prior approval has been granted to extend until June 1, 1990 the road closure previously granted by the Board on February 27 , 1990 to T & S Construction for the closure of Sunset Road between Highway 4 and Sellers Avenue in the Brentwood area. Supervisor Torlakson advised that there are concerns related to extending the time for this road closure and that there were people in the audience who wished to address the Board on this matter and requested it be removed from the consent agenda for discussion. The following persons appeared: Lane Laird, 3150 Sellers Avenue, Brentwood, advised that they owned and operated a fruit stand on Sellers Road and were concerned about the impact on their business if access is not available. Lee Laird, 3150 Sellers Avenue, Brentwood, commented that it was unreasonable to extend the closure of Sunset Road while the contractor renegotiates the contract with the City of Brentwood, and that there had been no work done in the past several weeks, and he desired the road to be reopened. Shirely Nunn, Route 1, Box 200, Brentwood, requested that no extension be granted for the Sunset Road closure at this time, noting that no work had been done for the past five weeks while the road was closed. She advised that they also had a fruit stand, a U-pick business and apple and cherry packing plants, and that lack of access to their business during the fruit season would create a financial hardship for them, the Lairds and others who depend on access from Sunset. Supervisor Torlakson commented on the need to support argriculture in East County and the need for access to the U-pick and packing plant operations. He noted the need to work with the City of Brentwood, inasmuch as the development creating the need for the sewer line is a Brentwood City project, and the road is a County Road. He requested the Public Works Director to comment. Michael Walford, Public Works Director, suggested the Board put the matter over to the afternoon to allow him secure further details from the contractor and the City of Brentwood. The Board agreed. Following consideration of the afternoon agenda, Mike Walford reported that he had talked to the contractor and the City, and it appears there is disagreement as to when the project will be completed. He recommended that the Board take immediate steps to revoke all previous approvals for the road closure, and that the road not be closed again until after the harvest season. IT IS BY THE BOARD ORDERED THAT all prior approvals granted for the closure of the subject portion of Sunset Road in the Brentwood Area are REVOKED, with the understanding that said road will remain open until after the harvest season.
