SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the Environmental documentation as being complete and
adequate.
2. Adopt the Rezoning/Preliminary Development Plan ( 2847-RZ) as
recommended by the County Planning Commission with conditions
of approval. (Exhibit A attached)
3 . Approve Final Development Plan #3020-89 and Subdivision #7324
as recommended by the County Planning Commission with condit-
ions of approval. (Exhibit A attached)
4 . Adopt the findings of the County Planning Commission as
contained in the Commission Resolution #4-1990.
BACKGROUND/JUSTIFICATION FOR RECOMMENDATION:
The County Planning Commission heard this matter on December 12 ,
1989. At that time, no individuals appeared to testify in opposit-
ion to the project.

This is the time heretofore noticed for hearing by the Clerk of the Board of
Supervisors on the above matter . The public hearing was opened, and no one
appearing in opposition, the public hearing was closed. On recommendation of
Supervisor Fanden, recommendations 1 , 2 , 3, and 4 are APPROVED; and
Ordinance No . 90- 26 , giving effect to the rezoning, is INTRODUCED,, reading
waived, and April 10 , 1990 is set for the adoption of same .

CONDITIONS OF APPROVAL FOR PRELIMINARY DEVELOPMENT PLAN 2847-RZ, DEVELOPMENT
PLAN 3020-89 AND SUBDIVISION 7324
1. This approval is based upon the Preliminary/Final Development Plan, Vesting
Tentative Subdivision Map submitted with the application dated received
July 20, 1989.
2. Except as specified in these conditions and the exhibits described above,
the guide for development shall be the Single Family Residential (R-6)
district, subject to the Zoning Administrator's review and approval at the
time of issuance of building permits. Any request made subsequent to the
approval of this project for modification of the standards applicable to
this project shall be made by recommendation of the homeowners association
to the Zoning Administrator, prior to issuance of building permits. There
shall be a minimum of 10 feet between buildings and not less than a 3 foot
sideyard.
3. Covenants, Conditions and Restrictions, Article of Incorporation and By-
Laws for a mandatory Homeowners Association shall be submitted prior to
recording the final map or equivalent mechanism subect to the review and
approval of the Zoning Administrator. These documents shall provide for
establishment and maintenance of fencing, drainage, lighting, etc. The
CC&R's shall prohibit long term parking of recreational vehicles.
4. At least 45 days prior to recording a Final Map, issuance of a grading
permit, or installation of improvements, submit two copies of a preliminary
soil and foundation report meeting the requirements of Subdivision Ordi-
nance Section 94-4.420. Improvement, grading, and Building plans shall
carry out the recommendations of the approved report. Record a statement
to run with deeds to parcels created by this subdivision acknowledging the
report by title, , author (firm) , and date, calling attention to report
recommendations, and noting that the report is on file in the Community
Development Department of Contra Costa County.
5. Prior to issuance of a grading or building permit, an acoustic study shall
be prepared to assure that the residential units shall have interior noise
level of not more than 45 dba of the CNEL scale. Noise attenuation mea-
sures such as type, size and location of sound barriers, additional grading
or relocation of buildings shall be submitted for review and approval by
the Zoning Administrator.
6. Prior to occupancy a sound barrier wall/fence shall be provided along the
project frontage of Pacheco Boulevard as determined by Condition #5 above
and subject to review and approval by the Zoning Administrator.
7. All units shall provide for an address visible from the street, which may
require illumination.
8. Prior to filing a Final Subdivision Map, the cul-de-sac street name shall
be submitted for approval by the Community Development Department.

9. A covenant shall be recorded with the final map providing for a disclosure
statement to prospective buyers that the development is in the vicinity of
an airport and the airports traffic patterns.
10. The applicant shall dedicate an avigation and noise easement over the
entire site relative to nearby airport operations at Buchanan Field as gen-
erally provided in the model easement attached to the December 12, 1989
Staff Report, subject to the review and approval of the Zoning Administra-
tor.
11. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement. Conformance with the
Ordinance includes the following requirements:
1. Constructing road improvements along the frontage of Pacheco
Boulevard. Constructing frontage improvements in accordance with
the addition of a 4-ft. , sidewalk and aligned in accordance with
the Precise Alignment plan for this section of Pacheco Boulevard
will satisfy this requirement. When widening the pavement, the
existing pavement shall be cut to a neat line along an existing
adequate structural section. The widening shall commence at that
line. An exploratory trench or pothole may be required to deter-
mine the limits of pavement widening.
2. Installing street lights on Pacheco Boulevard. The final number
and location of the lights shall be determined by the County
Traffic Engineer. This property has already been annexed to
County Service Area L-100 for maintenance of the street lights.
3. Undergrounding of all utility distribution facilities.
4. Conveying all storm waters entering or originating within the
subject property, without diversion and within an adequate storm
drainage facility, to a natural watercourse having definable bed
and banks or to an existing adequate storm drainage facility
which conveys the storm waters to a natural watercourse. This
may require the construction of Line B of the Drainage Area 57
plan from the site up to and under the Atchison, Topeka and Santa
Fe railroad tracks to the existing double 54 inch pipes located
on the north side of the tracks, or alternative drainage improve-
ments subject to the review and approval of the Flood Control
District.
5. Designing and constructing storm drainage facilities
required by the Ordinance in compliance with specifications
outlined in Division 914 of the Ordinance and in compliance with

design standards of the Public Works Department.
6. Verifying that all finished floor elevations are above the 100-
year flood elevation.
7. The Ordinance prohibits the discharging of storm waters to road-
side ditches.
8. Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
9. Submitting improvement plans prepared by a registered civil en-
gineer, payment of review and inspection fees, and security for
all improvements required by the Ordinance Code or the conditions
of approval for this subdivision. These plans shall include any
necessary traffic signage and striping plans for review by the
County Traffic Engineer.
B. Convey to the County, by Offer of Dedication, right of way on Pacheco
Boulevard as required for the planned future width of 84 feet.
C. Construct at the onsite road system, as shown on the Tentative Map, to
County public road standards.
D. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across driveways.
E. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or per-
manent, road and drainage improvements.
F. Submit a sketch plan to the Public Works Department, Road Engineering
Division, for review showing all public road improvements prior to
starting work on the improvement plans. The sketch alignment plan
shall be to scale and show proposed and future curb lines, lane
striping details and lighting. The sketch alignment plan shall also
include adequate information to show that adequate sight distance has
been provided.
G. Construct frontage improvements along the Batchelor property between
this subdivision and Subdivision 7325. These improvements will be a
continuance of the half section for Pacheco Boulevard as shown on the
Tentative Map. The Public Works DPp;�rtment will call up the Deferred
Improvement Agreement that originated as a requirement for LUP 2103-79
on the Batchelor property. (Coordinate the construction of frontage
improvements for this subdivision with the frontage improvements re-
quired of Subdivision 7325) .
H. Coordinate the construction of offsite drainage improvements with
those required of Subdivision 7325.

I . Prior to issuance of building permits, file the Final Map for Subdi-
vision 7324.
ADVISORY NOTES
A. The applicant will be required to comply with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the Countywide Area of Benefit as
adopted by the Board of Supervisors. Currently the fee for the Martinez
region of the County is $2,300 for each added single family residence.
B. The applicant will be required to comply with the drainage fee requirements
for Drainage Area 57 as adopted by the Board of Supervisors.
C. Certain improvements required by the Conditions of Approval for this de-
velopment or the County Subdivision Ordinance Code may be eligible for
credit or reimbursement against said fee. The developer should contact the
Public Works Department to personally determine the extent of any credit or
reimbursement for which he might be eligible.
D. Comply with the requirement of the Contra Costa County Consolidated Fire
District and the Mt. View Sanitary District.
E. The applicant will consult with the California Department of Fish & Game.
