SUBJECT: Report on Use of Overtime in the Contra Costa County
Fire Protection District
The Board received the March 29, 1990 report from the Director
of Personnel relative to the payment of overtime to incumbents of
the class of Battalion Chief in the Consolidated Fire Protection
District. (A copy of the report is attached and included as a part
of this document. )
Supervisor Powers proposed that consideration be given to
using captains in situations where overtime may be required as a
cost saving procedure.
IT IS BY THE BOARD ORDERED that receipt of the referenced
report is ACKNOWLEDGED.
IT IS FURTHER ORDERED that the County Administrator and the
Chief of the Contra Costa County Fire District are REQUESTED to
explore the use of captains in situations where overtime is
required.

SUBJECT: Battalion Chiefs' Overtime

On March 6, the President of the International Association of Firefighters,
Local 1230, met with me to discuss the payment of overtime to incumbents of
the class of Battalion Chief in the Consolidated Fire Protection District.
The union claimed the payment of overtime to Battalion Chiefs is unlawful .
Earlier, Local 1230 had filed a grievance on a related issue. and the matter is
presently before an arbitrator.
In the spring of 1988, the Chief of the Consolidated Fire District requested
that it be allowed to pay overtime to Battalion Chiefs when they were recalled
to fill in for other absent Battalion Chiefs. District practice had been to
use a Fire Captain as an Acting Battalion Chief and replace the Captain in the
acting Battalion Chief's role by recalling an off-duty Captain and paying him
overtime. The reason given was that paying Battalion Chiefs overtime is
preferable since it results in the replacement of an absent management
employee with another management employee in the same job classification.
Based on this and other reasons given as to the advantages of paying Battalion
Chiefs overtime, the County Administrator approved the Chief's request.
Effective July 1, 1988, the Battalion Chiefs were removed from the Overtime
Exclusion list by direction of the County Administrator under authority of
Resolution No. 87/687, (Part D.1) . (See attached memorandum from Bill
Hamilton, Personnel Department, to County Auditor, Don Bouchet dated September
1, 1988) .
Resolutions 87/687 and 89/684 which generally prohibit overtime for management
employees, authorize the County Administrator to exclude certain management
positions from the overtime exempt list, which was done in this case. But the
County Administrator has not undertaken to control the overtime authorized by
the Chief of the Consolidated Fire District.
On March 16, the Personnel Department reported to the County Administrator the
Battalion Chief overtime authorized in the Consolidated Fire District (copy
attached) . After reviewing the report, the County Administrator issued a
memorandum terminating the payment of overtime to Consolidated Fire District
Battalion Chiefs effective March 21, 1990 (copy attached) . The County
Administrator based this action on his conclusion that the dollar amount of
overtime payments were excessive and should not be continued. .

The position of the Fire District is that most of the overtime occurred
because authorized Battalion Chief positions could not be filled. The
district requested a Battalion Chief examination in December of 1988. Test
development by the Fire District staff was finalized in April of 1989; the
examination was announced on May 5, 1989, and the employment list promulgated
on October 20, 1989. Two appointments were made on December 1, 1989.

classifications of Battalion Chief and Battalion Chief-Riverview have been
placed on the "overtime exempt exclusion list" per authorization by the Office
of the County Administrator. Therefore, employees in these classifications are
eligible to receive pay when working overtime.

Dear Chief Maxfield:
The exclusion of the class of Battalion Chief from the overtime
exclusion provisions of the Management Compensation Resolution
(Board of Supervisors Resolution 89/684) is terminated effective
Wednesday, March 21, 1990 . Thereafter the Contra Costa County
Fire Protection District Battalion Chiefs will not be entitled to
.overtime compensation.
