THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on April 3, 1990 by the following vote:
AYES: Supervisors Powers , Schroder, McPeak, Torlakson & Fanden
NOES: None
ABSENT: None
ABSTAIN: None RESOLUTION NO. 90/198
SUBJECT: Completion of Warranty Period, Release of Cash Deposit,
and Declaring Certain Roads as County Roads,
Subdivision 6959, Martinez Area.
On February 14 , 1989 this Board resolved that the
improvements in Subdivision 6959 have been completed; and
On March 21, 1989 this Board approved a Subdivision
Agreement for Improvement Warranty with Lamond-Katzakian Joint
Venture, subdivider, whereby said subdivider agreed to guarantee
and maintain the completed improvements as required in said
Subdivision Agreement for Improvement Warranty for one year.
NOW THEREFORE BE IT RESOLVED that the improvements have
satisfactorily met the guaranteed performance standards for one
year after completion and acceptance; and
BE IT FURTHER RESOLVED that the hereinafter described roads,
as shown and dedicated for public use on the Final map of
Subdivision 6959 filed March 29, 1989, in Book 332 of Maps at
page 4, Official Records of Contra Costa County, State of
California, are ACCEPTED and DECLARED to be County Roads.

BE IT FURTHER RESOLVED that the Public Works Director is
AUTHORIZED to refund the $1, 055 cash deposit (Auditor's Deposit
Permit No. 153220, dated March 6, 1989) plus interest in
accordance with Government Code Section 53079, if appropriate, to
Midhill Ridge Partners (Lamond-Katzakian Company) , pursuant to
Ordinance Code Section 94-4.406 and the Subdivision Agreement.
